反思政治性国际劫机犯罪司法协作困境 　　摘要： 　　各国意识形态领域的差异以及特定国际事件的国家利益纠葛共同影响了对政治犯不引渡原则的适用，进一步导致了与“政治性目的”有关的国际劫机犯罪的司法协作困境重重。此类劫机事件的困境实质上是各国国家利益、世界人权事业发展与政治自由以及国际打击劫机犯罪等诸多需要的体现。而解决困境的现实方案则是：将具体的“政治性”国际劫机事件所涵括的现实国家利益纠葛作为首要的价值砝码，兼顾事件的人权保护意义与政治自由价值，并在此基础上分类处理。 　　关键词：政治犯不引渡；国际劫机犯罪；价值分析；解困设想 　　中图分类号：D926文献标识码：A文章编号2012 　　An Analysis of the Difficulty in the Judicial Cooperation against the International Crimes 　　of Skyjacking with Political Aims 　　——From the Aspect of Principle of Political Offense Exception 　　LI De Sheng1，XU Qiliang2 　　（1.Criminal Law School China University of Political Science and Law，Beijing 100088，China； 　　2.the Peoples Procuratorate，Qixing District，Guilin 541004，China） 　　Abstract：The adoption of the principle of political offense exception has been influenced by the combined effect of ideological differences among nations and the conflict of national interests in certain international events，which further put the judicial cooperation against the international crimes of skyjacking with political aims into a tight corner.Essentially，the predicament is a reflection of national interests，the development of human rights and political freedom，as well as the necessity of fighting against the crime of skyjacking.Therefore，the practical solutions of the problem should be classifying the specific crimes of hijacking.And during this process，national interests embodied in the crimes of skyjacking with political aims should be chiefly concerned，with the protection of human rights and the value of political liberty considered at the same time. 　　Key words：political offense exception；international crime of skyjacking；analysis of value；tentative idea to solve the problem 　　近年来随着国际合作打击危害民用航空安全犯罪的加强，危害民用航空运输安全犯罪多发的恶性趋势得到了有效遏制。各国在国际协作打???劫机犯罪的过程中，也达成了一系列具有针对性的国际公约，但同时也留下了一个严重的条约规制缺陷，各国基于特定政治目的与国家需要的考虑，在对“真假政治性”本文所指的真假政治性：具体涵括出于真实的政治自由与宗教信仰追求，而为政治避难的；同时也涵括劫机犯罪行为发生后以政治目的为脱罪理由的主张，简而言之，可以说是真实的政治性目的与虚假的政治性目的的集合。目的为动机的国际劫机犯罪司法协作问题上，未能达成一致共识，并最终以国际公约的形式予以明确约定。各国对
