AbstractTherealestateexpropriationprocedureisthecoreoritssystem,inthelegitimategovernmentalexpropriationprocessoftheimmovableproperty.Atthepresentstage,urbanconstruction,duetotheacceleratedpaceofurbanizationandtherapidprogressoftheurbanplanning,hasbecometheimportantcarrierandthebasisofthelocaleconomy.However,intheprocessoflevy,theGovernmentandpeopletendtobeimposedconflictsofinterests.Thereason,ontheonehand,isthattheGovernmentmisconductsinthedemolitionprogram;ontheotherhand,isthatthereisalackoflegalproceduresintherealestateexpropration.It’sjustthelackoflegitimacy,whichdoesnotcomplywiththebasicelementsoflegitimateprocedures,beingthe“improper”legalprocedures.Ithasmuchcontributedtotheimbalancedistributionofbenefits,whichformsaconfrontationbetweenthetwopartiesandgreatlyaffectsthesocialstablity.Privatepropertyownership,asacitizensthebasicrights,isprotectedbythebasiclaws,whichmeansthatitcannotbeviolatedbyanygroup,organizationorindividualswithoutbeingauthorized.Sodoestherealestate,whichisapartoftheprivateproperty.Anyorganizationandindividualswhoaremeanttolimitordeprivecitizens’privateproperty,mustfollowthelegalprocedures,whichcanstronglyprotecttherightsfrombeingvoilated.Procedurejusticehasitsownvalues,inadditiontorealizingtheentityjustice,whichincludesparticipation,openness,humanityandprocedureintime,efficiency,respectionforpersonaldignity,etc.Inordertocomplywiththeneedsofthedevelopmentofthetimes,“theOrdinanceoftheHousingLevyandCompensationontheState-OwnedLand”hasbeenenactedin2011.Theordinance,thoughseemingtohavesomeimprovements,stillreflectsmanyshortcomingsintheprocedurelegitimacyinfact.Thisarticle,followingthecluesofthemeasuringfactorsintheprocedurelegitimacy,asExamplifiedby“theOrdinanceoftheHousingLevyandCompensationontheState-OwnedLand”,pointsoutitsshortcomingsafteranalysingtherelevanttheories.Andinthelightofthesedefects,thetextgivessomemeasuresandsuggestionsonrealestateexpropriationprocedures,andlaysemphasisontheimportanceoftheenactionoftheprocedurelegitimacy,aswellast
