摘要法律与道德的关系是神秘的但可以言说，法律与道德的关系在社会发展的每一个时期都有讨论的必要，并且是十分之必要；社会发展具有选择性，这也就决定了在不同的历史发展时期法律与道德的关系形态有不同呈现方式。具有美德的行为会被法律认可，甚而被固化；而失德的行为会引发社会广泛的谴责，进而在社会中人们的思维就容易出现法律必须维护道德的信条，或者通俗的说：法律要严惩不道德的行为。这不是一个新问题，但它总有各种面貌呈现于不同的人们面前。面对他人处于险境而自身有条件进行施救却没有施救的人在社会中引起了很大的愤怒情绪，见死不救行为冒犯了深受传统文化影响的国人，挑战了有良知的人的道德情感和追求美好生活的愿望，见死不救的行为人受到社会的广泛谴责是毫无疑问的。遭受社会谴责的行为要如何在社会生活中减少，社会各界献计献策，用法律的手段制裁见死不救行为受到广泛的追捧。但是，也有很大一部分人对用法律来规制人们的道德生活抱不赞同的态度，见死不救入罪在理论和实践中都会陷入困境，甚至会产生更不道德的可能。理性对待法律与道德的关系，审慎地规划法律维护道德的限度是对待见死不救行为及其他一些社会不道德行为该有的态度。绝对的严惩不道德行为已经被理论和实践否定了，也是不可能实现的，因此道德在何种情况才会与法律合二为一，法律如何维护道德，法律与道德的边界在哪等等问题需要得到一些比较明确的答案。本文通过“见死不救”这一社会广泛讨论的现象的现实分析探讨法律维护道德的限度。见死不救本身是一个普通的不道德行为，但是在目前的现实条件下所造成的后果触目惊心，以至于社会舆论大幅倾向于“见死不救罪”入法。这是一个值得深思的现象，道德何以成为法律？法律维护道德要有一个合理限度，这个限度应该以一些前提为基础，在这些基础上看待法律与道德，部分道德成为法律是必要的，但一定要全面把握社会事实，法律维护道德不应产生其他的不道德。关键词: 法律；道德；见死不救；法律化；合理限度AbstractThe relationship between law and morality is mysterious but speech, every time the relationship between law and morality in the social development is necessary to discuss, and necessary; social development is selective, which also determines the in different historical periods in the development of the form of the relationship between law and morality have different display modes.
