上海交 上海交通大学 MPA 学位论文 我国精神障碍患者监护公共干预机制研究—以上海为例 万方数据 万方数据 第一部分：主要简单介绍目前我国精神障碍患者监护不足导致社会问 题的背景，揭示本文研究意义，简叙国内学者研究成果及相关文献，并简 要陈述本文研究的思路方法及相关数据来源。 第二部分：引入经济学中的外部性理论及公共干预理论阐述公共干预 的必要性，提出实施公共干预的实现路径和基本模式。即本文研究的监护 公共干预机制，均从监护主体的决定、监护事务的执行、监护监督三方面 研究公共力量在其中所起的作用 第三部分：简述我国目前现行的精神障碍患者监护制度设计，并通过 对上海部分社区精神障碍患者监护人问卷调查、上海曾肇事肇祸精神障碍 患者监护数据统计分析，以上海为例揭示现行制度下精神障碍患者监护中 的问题并分析原因。 第四部分：比较研究境外国家和地区公共力量在精神障碍患者监护中 发挥的作用及其相关制度设计。 第五部分：提出完善我国精神障碍患者监护公共干预机制的基本构想。 其中，在监护主体的决定方面，提出设立监护法庭、社区精防联勤工作小 组等决定机关，并设计了意定监护、法定监护和指定监护相结合的监护主 体决定机制，提出公共部门担任监护人的初步构想。在监护事务的执行方 面，详细阐述了公共监护机制的框架设计。在监护监督方面，提出建立监 护监督、失职惩罚、监护回归、公权监督四大机制，并提出了监护、裁定 两分的监护监督理念。 关键词：精神障碍患者 监护制度 公共干预 外部性 II The research on Public intervention mechanism of Mental disorders guardianship in China --Taking Shanghai as an example ABSTRACT At present, mental disease has become common disease, patients with mental disorder has become a large group. As one of the vulnerable groups, the entire social should pay attention and protect patients with mental disorder. On the other hand, some severe mental disorders because of the spirit cannot be controlled, a serious threat to themselves and their guardians, including public safety of life and property. In recent years, patients with mental disorder for trouble-making case events occurred frequently. These cases reflect not security problems, but how to carry out effective monitoring to the social problems of mental disorders group, is Chinas problem in system level design of guardianship system. So far, monitoring of patients with mental disorders in our country the situation is still dominated by family autonomy, the state and social forces involved insufficient in the guardian select, guardianship executive support, guardianship supervision etc. No as guardian inappropriate choice, guardianship transaction cant get help, monitoring behavior without supervision, is the main cause of the guardianship the lack of patients with mental disorders.
