重庆大学硕士学位论文中文摘要 重庆大学硕士学位论文 中文摘要 I I 摘 要 十一届全国人大常委会第十九次会议在北京人民大会堂闭幕，会议通过了《中 华人民共和国刑法修正案（八）》，该修正案首次规定，在道路上驾驶机动车追逐 竞驶,情节恶劣的,或者在道路上醉酒驾驶机动车的,处拘役,并处罚金。同时规定,有 飙车、酒驾行为,同时构成其他犯罪的,依照处罚较重的规定定罪处罚。至此，“酒 驾”入刑几经审核，终于尘埃落定。 鉴于当前我国危险驾驶行为高发、多发，危险驾驶的行政治理力度有限，尤 其是酒后驾驶行为随处可见，我国刑法惩治上述行为又存在一定的缺陷，而国际 社会又普遍采用刑法惩治危险驾驶行为的做法，因此，我国首次在刑法体系之中 加入了对于“酒后驾驶”的刑法判定，以明确国家对此类行为的否定性评价，从而改 善我国道路交通安全现状。 本文以刑法修正案八第 22 条为视角，通过对“酒驾”行为的理论分析以及参考 国外先进立法，结合我国现有刑法体系、行政处罚制度，对我国“酒驾”入刑后的实 务操作进行分析，并且同时提出完善措施。 关键词：刑法修正案（八），“酒驾”入刑，完善措施 重庆大学硕士学位论文英文摘要 重庆大学硕士学位论文 英文摘要 II II ABSTRACT Amendment Ⅷ to the Criminal Law of the Peoples Republic of China the first time, the amendment provides that in pursuit of competition on the road driving a motorized vehicle, aggravated or drunk driving a motor vehicle on the road, and at the detention and a fine .
