I I 摘 要 劳动合同关系是否和谐稳定，不仅关系到企业经济的可持续发展，还关系到 整个社会的协调发展与稳定。 近几年来,随着工业化、城镇化和经济结构调整进 程的加快,企业制度改革不断深化,企业形式和劳动关系日趋多样化,劳动用工制 度发生了深刻的变化,劳动关系领域出现了一些新情况、新问题,劳动者合法权益 受到侵害的现象时有发生,在一些地区、行业和单位甚至相当严重,影响了劳动关 系的和谐稳定。 《劳动合同法》及《劳动合同法实施条例》的出台，在一定程度上缓解了这 些问题，减少了经济社会发展中的不和谐因素。但由于该法本身仍有若干不足和 缺陷，在解决旧问题的同时又产生了一些新问题，这不仅影响到保障劳动者合法 权益的实现，也影响到企业的长远发展和社会的和谐稳定。 劳动关系和谐,必须走法治之路。近年来,随着我国《劳动合同法》、《就业促 进法》、《劳动争议调解仲裁法》相继出台,《社会保险法》、《企业工资条例》等 也正在制订中。要完善劳动法律关系，解决实践中出现的问题就必须不断地完善 相关法律，也要在法律的实施和执行环节做相应的配套工作。 本文以《劳动合同法》实施的现实情况作为研究的出发点。首先，阐述了《劳 动合同法》的立法背景和立法定位；其次，从实证研究角度出发，揭示了《劳动 合同法》实施后凸现的不良现象；然后，指出了《劳动合同法》本身存在的若干 不足和缺陷；另外，对该法的不完善之处提出了针对性的建议；最后，阐述了完 善该法的现实意义。 关键词：劳动合同法；不足；完善； II II Abstract The harmony and stability of the labor contract relates not only to the sustainable development of an enterprise’s economy, but also the coordinated development and stability of the whole society. In the last few years, along with the quickening of industrialization, the urbanization and readjustment of the economic structure advancement, the deepening of the enterprise system reform, the diversification of the form of enterprise and the work relations day by day, the labor employing system has transformed deeply. New situations and new questions have occurred to the work relations. The labors’ legitimate right and interest has been violated constantly. Even in some areas, profession and unit it was so serious that the harmony and stability of the work relations was seriously affected. The releasing of Labor contract law and the Regulations for the Implementation of the Labor Contract Law, alleviated these questions to a certain extent, reduced the harmonious factor on the way of the development of economic society. But because this law itself still had certain insufficiencies and flaws, while we are solving the old questions we have some new ones, which not only affects the realization of the worker’s legitimate rights and interests , also affects the enterprises long-term development and societys harmony and stability
