万方数据 万方数据 中文摘要 土地承包经营权是农民的一项重要的用益物权。在稳定对农民承包经营权不变的基 础上，通过相应的法律法规加以引导和规制，再辅以完善的配套制度，使该权利实现有 序流转，能够促进土地规模化集约化经营,提高农村地区的经济效益和竞争力。目前承 包经营权流转这一现象在农村地区有迅猛发展势头，但是很多问题也逐渐暴露出来：针 对该权利流转的相关法律制度措施存在缺陷；相关配套制度发展严重滞后；土地信托制 度不完善等，这些都严重影响了承包经营权的有序有效流转，不利于农村经济的快速发 展和综合效益的提高。因此，针对以上突出问题，通过比较借鉴国外发达国家农用土地 流转制度，在法律措施、配套制度、土地信托等方面加以着手，提出切实可行的解决思 路或方案，通过多种途径将承包经营权流转制度加以完善，使其能够更好地发挥出应有 的作用，实现农村经济的持续高速增长，提升农业经济的竞争力。 文章共分为五部分。第一部分为导言，主要基于我国农村现状和发展特点，介绍了 承包经营权流转制度的研究背景和意义、国内外研究现状、研究方法、重难点和创新点 等。 第二部分主要介绍了承包经营权及其流转制度的相关理论。通过阐释相关法律法 规，加上理论界现有的学说观点，提炼出承包经营权及其流转的科学合理的概念界定及 法律特征，并结合农村实际，总结出现有的流转方式，并指出在新的历史时期完善这一 制度的重要意义。 第三部分介绍与分析了发达国家农用土地流转制度。从英美法系和大陆法系两个不 同的法系国家来论述说明，通过比较和借鉴，从中提炼出了符合我国国情的有助于完善 我国承包经营权流转制度的若干经验和启示。 第四部分主要分析了承包经营权流转制度存在的主要问题，详细说明了农村流转实 践中的种种问题，包括法律制度上存在的缺陷和配套制度上的不完备,以及土地信托制 度存在的主要问题。 第五部分主要针对上一部分所提出的流转制度中存在的主要问题，从法律措施和配 套制度两个方面提出了完善土地承包经营权流转制度的建议，同时也针对性的提出了完 善我国土地信托制度的若干建议。 关键词：农村；集体土地；承包经营权；流转 I Abstract Land contract and management rights of farmers is an important usufructuary.
