摘要本文是一篇翻译报告，翻译原文为美国学者弗兰克·谢克特的著作《商标法的历史基础》（The Historical Foundations of the Law Relating to Trademarks）第七章。原文主要讨论商标的性质与功能，如何认定商标侵权行为以及如何有效给予法律救济。翻译过程中，笔者特别关注原著中大量的名词化结构，为此选取名词化结构作为译者翻译报告的研究对象。通过对名词化结构的进一步分析和研究，笔者拟从三个方面：定义、表现形式以及功能对名词化结构进行探讨，并提出汉译方法及技巧，具体而言，笔者主要采用直译，词类转换以及拆分等方法或技巧。关键词：名词化结构；功能；直译；词类转换；拆分 Abstract This report is based upon the English text of Chapter Seven of the Historical Foundations of the Law Relating to Trademarks, written by Frank Schechter of the New York Bar. This Chapter mainly discussed the nature and the functions of trademark as well as discussed how to identify trademark infringement and how to afford redress or relief. While doing the Chinese translation of the said chapter, the author of this report finds that great many nominalization structures permeated the English text. The author attempts to analyze the following three aspects of English nominalization: definition, forms and functions. Then the author puts forward some translation methods and skills to solve the problem that may be encountered in the Chinese translation of the English nominalization, namely, literal translation, conversion of parts of speech and unpacking and packaging.
