In the field of CCT, the U.S., EU and Japan are in the leading position, and have great technical advantages. Although CCT has been rapidly developed in China recent years, but due to the historical reasons and imperfect legal system, clean coal technologies in China remain a considerable gap compared to developed countries. To develop CCT in China, it needs supports involving political, economic and legal environment, among which the legal safeguard is particularly important. The legalization of CCT strategy and policy of the country will help improve the authority and stability of the system. The CCT can develop with a specific goal and plan through a reasonable mechanism designed of incentives and restriction, so that it will also maintain a high degree of competitiveness and long-term vitality. Chinas current energy development status and legal construction level determines the clean coal technology legal system still exist a series of problems, like: have no special CCT roadmap or planning, lack of operational provisions, incentive and restraint mechanisms are not perfect, the administration management system is not sound enough, ect.
