On the perspective of type, it includes non-right representative caused by improper registration and purported representation and beyond-right representative caused by exceeding representative authority and business competence. Due to the different causes of reliable facts, each type of liability of apparent representative has different application rules. It belongs to the category of reliance-based liability (Vertrauenshaftung) per the legal dogmatic classification. Therefore, on the systematic constitutes, the liability of apparent representative follows the general liability elements of the reliance-based liabilities: reliable facts; good faith of the third party; reliable investment of the third party; the rationality of the third party ’s reliance and imputability of the responsible person. Due to the different causes and levels of each reliable fact, each element has a dynamic application process.
