PAGE 论文编号：200400214309 论文编号：200400214309 浅析无因管理之债的若干问题 院系名称：人文与社会科学学院 班 级：法学043 学 号：200400214309 学生姓名： 指导教师： 2008年 6 月 中原工学院2008届法学专业毕业论文 浅析无因管理之债的若干问题 PAGE I 中文摘要 在通常情况下，管理他人事物必须要有合法的根据，或者受人委托或有法定义务，否则就有可能构成侵权行为，然而无因管理则是一种例外情形。无因管理成立后，在管理人和本人之间产生的债权债务关系就是无因管理之债。无因管理是无因管理之债的发生根据，无因管理之债是无因管理的法律后果。管理人有管理人的义务，本人有本人的义务。若未履行或者不适当履行其义务，对对方造成损害的，应向对方承担债务不履行的责任。无因管理之债的价值主要体现在鼓励社会成员互相帮助，以弘扬良好社会公德和防止他人利益损害或增进他人的利益；还体现了公平正义的法律精神反映出社会对于维护公序良俗行为的赞许。伴随着社会文明的发展，人们情操的高尚，无因管理行为的发生就必将越频繁。但由于多种原因,这项法律制度目前在我国的运用范围和实现程度并不尽如人意：无因管理之债在管理人赔偿责任方面、本人义务方面、报酬请求权方面和管理人排除第三人侵害方面存在的种种问题，从而从完善管理人免责事由的规定、本人受益情况及相应义务的规定、报酬请求权制度的规定和管理人代位权的规定这几个方面来促进我国社会主义市场经济的发展与完善，充分发挥社会主义法律制度在我国社会主义建设中的重要作用。 ??? 我们应当在给予无因管理人以社会荣誉的同时，将其纳入无因管理制度中予以国家法律上的保护，建立一套社会保险、社会补偿、和社会救济制度，赋予无因管理这个古老的法律制度以新的寓意和价值。 关键词：无因管理之债，管理人，受益人，管理事务 Abstract Usually, managing the things of others would be have a legal basis, or be entrusted by person or have a legal obligation, otherwise infringement behavior probably occurs, however for no reason management is a kind of exception.
