PAGE PAGE IV 摘 要 随着现代民主的进步和法制的发展，人的尊严与权利越来越受到重视，因此，档案 领域公民权利保护相对薄弱的问题进入了人们的视野。档案法律是保护公民权利的最佳 手段，缺乏法律支撑的公民权利将会成为无源之水、无本之木。但从世界范围来看，我 国档案法制建设还相对滞后，特别是作为档案领域的根本大法-- 《档案法》的发展更是 缓慢，档案工作中出现的一些公民权利问题，不能得到很好的解决。切实维护公民权利， 需要法制观念的深入和法律手段的规范，这不仅是档案法制建设的重要内容，也是完善 我国社会主义民主法制建设的迫切要求。鉴于此，以公民权利为视角，探究《档案法》 的完善及修改，有着非常重要的现实意义。 本文主体共四部分：第一部分阐述档案及《档案法》的相关概念，揭示了档案价值 属性的时代演变，是《档案法》功能得以延伸与拓展重要原因。第二部分主要论述《档 案法》所涉及到的公民权利，明确界定了档案所有权、知情权、隐私权的涵义及特征。 第三部分对中外档案法公民权利保护进行比较，指出了我国《档案法》在公民权利保障 上存在的不足，并分析了原因所在。第四部分在总体原则基础上，以《档案法》修改为 契机，提出了保护档案所有权、知情权和隐私权的相应对策。 关键词：档案法 公民权利 所有权 知情权 隐私权 Abstract With the progress of democracy and the development of legal system and institutions, the dignity and right of people have been paid more and more attention to.Therefore, the civil rights that have been weakly ptotected approach the people in the archival science relatively. Because the optimum methods to protect civil rights are archives laws and regulations, if lacking of the supporting of laws, civil rights should be the water which has no headspring and the tree which has no wood. But from a global point of view, construction of our country’s archives legal system has fell behind comparatively,especially the Archives Law has developed slowly whitch is considered as the fundamental law. Then there are a few problems about civil rights that can`t be solved completely in the archives science. Consciously, it need penetration of legal system and criterion of legal method to protect civil rights. This is not only an important part in the established of archival legal system, but also the need to perfect our political democracy.Because of this, and in the light of civil rights,there is a greatly important and practical meaning during researching into further improving and perfecting in the Archives Law.
