万方数据 万方数据 商品房借名买卖中物权归属研究 摘 要 商品房借名买卖的现象在现实社会中屡有发生,由此所产生的 法律纠纷也层出不穷。如何确定此类案件中商品房的归属以达到平 衡各方利益的目的,是本文的主要研究对象。 本文共分四章。第一章是对商品房借名买卖的司法处理现状的 总结和问题的提出。通过引入商品房借名买卖的案例,分析并归纳 了此类案件中法院判决思路的不当之处。第二章从商品房交易动态 过程的角度论证了确定商品房借名买卖中物权归属的方式。在讨论 了借名协议的法律性质等基础问题之后,指出了商品房借名买卖中 可能出现的两种商品房所有权变动过程,并通过论证分析,明确了 名义登记人参与到商品房所有权变动过程的思路才是符合法律逻辑 的。第三章是从静态权利外观的角度论证了第二章所确定的判断物 权归属的思路的正确性。主要阐明了商品房登记的效力和登记错误 的问题。第四章分析了在前述确定物权归属的思路下如何保护实际 出资人、第三人利益的问题。 关键词:借名买卖,物权变动,商品房登记的效力,利益平衡 1 万方数据 THE RESEARCH OF THE OWNERSHIP OF COMMODITY HOUSES PURCHASED VIA BORROWING OTHER PEOPLE’S NAMES ABSTRACT The phenomenon of borrowing other people ’s names to purchase commodity houses occurs frequently in reality, which constantly results in numerous legal disputes. The article focuses on the issue of how to determine the ownership of commodity houses under aforesaid circumstances so as to balance the interests of all parties involved. The article is divided into four chapters. The first chapter is about the summary of current situation and existing problems of judicial handling of cases in which the commodity houses are purchased via borrowing other people ’s names. Through introduction and analysis of cases concerning commodity houses purchased via borrowing other people ’s names, this chapter summarizes the inappropriate places in the judicial reasoning of such cases.
