山东科技大学硕士学位论文摘要 山东科技大学硕士学位论文 摘要 摘 要 二十世纪三十年代西方国家首先提出了有机农业的观点。有机农业的基本理念是保 护环境，实现农业的可持续发展。有机农业具有兼顾生态效益、社会效益和经济效益的 多功能性。相对于西方国家的有机农业因农民的环保意识而起源，我国的有机农业是在 国际贸易为主推动力的推动下发展起来的，因此在发展过程中，以出口有机产品突破绿 色壁垒成了有机农业发展的动力，此外，由于消费者认知水平不高，对有机产品多停留 在“吃得放心”的层次上，对本地化市场开发重视不足，对于发挥有机农业的环保作用 不利。有机农业对于生态系统、自然资源、动物福利等有着重要而深远的意义。在环境 法视野下，把有机农业的一些对策法律化、制度化，才能使有机农业可持续发展有根本 的保证。因此，建立健全有机农业法律制度势在必行。本文在对有机农业的必要性进行 解读的基础上，对国内外有机农业制度进行考察，得出国外有机农业制度对我国有机农 业制度的启示，提出了完善我国有机农业制度的基本思路和建议。 关键词：有机农业 环境外部性 法律制度 ABSTRACT At the 30s of the 20th century， wester n countries first proposed organic agriculture. The basic idea of organic agriculture is to protect the environment and realizing susta inable development of agriculture.Organic farming has both ecological benefit and economica l benefit and socia l benefit in versatility. Rela tive to the organic agriculture in wester n countries for farmers ，awareness of environmental protection and the origin of organic agriculture in China is ma inly in internationa l trade development ， which as well as impetus of the development process and so on, to export organic products breakthrough green barriers, the development of organic agriculture became, in addition，the consumers cognitive level is not high, to organic products in eat more at ease level, to pla y the role of organic agricultural environmental protection and loca lization market development value. Next, put in environmental view some countermeasures of organic agriculture, inst itutiona liza tion, can make lega lization of organic agriculture in susta inable development is the fundamenta l guara ntee. Therefore, establishing a perfect lega l system of organic agriculture is imperative. Based on the necessity of organic agriculture and theoret ica l basis,a lso on the basis of the interpreta tion of organic agriculture system at home and abroad are in no condition reviewed, and it also puts forward the suggest ion of organic agriculture system.
