I 摘 要 多元化的环境民事纠纷解决机制的构建和完善已是一种发展趋势，为缓解日益严重的 环境危机，出于解决环境民事纠纷的目的，似乎又是迫在眉睫。但如何构建和完善，却是 摆在我们面前的一道难题。本文从环境法的视角对此问题进行了探讨。 首先，梳理了环境纠纷的含义及其分类，分析了现行环境民事纠纷的诉讼解决机制和 非诉讼纠纷解决机制。环境污染和破坏造成不同利益主体之间的环境利益纷争，并引发了 大量地环境民事纠纷，因此现行环境民事纠纷解决机制的纠纷解决能力受到了严峻考验， 鉴于纠纷解决方式自身以及制度设计方面存在的缺陷，致使现行的纠纷解决机制无法实现 解决纠纷的目的。 其次，总结和评析了我国环境民事纠纷解决机制的研究成果，以期对多元化的环境民 事纠纷解决机制的完善提供参考。多元化已是一种共识，现行的研究也是在这一共识之下， 围绕多元化的环境民事纠纷解决机制的具体制度内容以及如何构建和完善展开，成就与不 足并存。 最后，提出了完善建议。发展趋势为构建和完善指明了方向，事物的发展是有其规律 性的，看清了趋势也就遵循了事物发展的规律。现代多元化纠纷解决机制的理念并不推崇 自在的多元化状态，也不是对这种事实状态的简单承认，而在于积极进行理性的建构。目 标是实现诉讼与非诉讼机制的协调互动。明确各解决方式的适用范围，做到各司其责，而 又保持各方式之间的协调，才能实现纠纷解决机制的定纷止争的功效。 关键词：环境民事纠纷;诉讼解决机制;非诉讼解决机制 II Abstract In order to alleviate the increasingly serious environmental crisis and for the purpose of addressing environmental civil disputes, the build and the perfection of the diversified resolution mechanism of environmental civil disputes is a trend and seems to be extremely imminent. But how to construct and consummate, is actually a difficult problem before us. This article discussed this issue at the perspective of environmental law. First of all, this article has combed the meaning of environmental disputes and classification, has analyzed the present lawsuit solution mechanism and the non-lawsuit solution mechanism of environmental civil disputes. The environmental pollution and the destruction caused environment benefit conflicts in the different stakeholders and triggered a large number of the environment civil disputes. Therefore, the ability of the settlement mechanism of the present environmental civil disputes faces severe test. In view of its own problems as well as the flaws in the system design, it caused the present dispute settlement mechanism can not achieve the purpose of resolving disputes.
