But the Law does not prescribe the nature，limit，and scope about this joint and several liability in detail，which would lead some difficulty to law application. ESO is social neutral organization whose mission is to provide external technical information or service. Based on the need for decentralization of environmental law enforcement，it is derived from the executive departments. The Essence of environmental services is to provide external neutral EIA information，environmental information and environmental monitoring equipment and facilities maintenance services. These are the technical basis of decisions from environmental enforcement agency. The form of ESO’s liability is fault liability，which is based on the failure to meet legal obligations. This joint and several liability may be civil liability，economic administrative liability or criminal liability including a fine or a penalty. Although this liability constitute joint with polluters’liability，but the two are not based on contributory tort. Therefore，ESO’s liability is attached and vicarious to other tort-feasors.
