第 31 卷第 6 期 西华大学学报(哲学社会科学版) 2012 年 12 月 VoI. 31 ,No.6 Journal of Xihua University (Philosophy Social Sciences) D回.2012 ~击学研先· 农民经济权益的内涵、特殊性及其法律保护 张长健 (西南政法大学民商法学院 重庆 401120) 摘 要:农民权益特别是经济权益保护的缺位事实上已经成为制约中国农村经济进一步发展和农民增收的瓶颈。至然十七届三中全会明确提出了保护农民的政治、经济、义化、社会权益，但是要想将农民经济权益保护落到实处，必须明确其内涵并将其加以具体化和体系化，同时应将经济权益中的部分重妥权益上升为权利。因此，分析 农民经济权益的带殊性、找到一条符合中国农村村情的农民经济权益法律救济之路显得非常重妥。为此，本文 选择三个关键性的问题进行分析:屋清和重构农民经济权益的内涵和体系，对农民经济权益的特殊性加以概括，通过立法安排和制度设计建立起对农民经济权益的多层次全方位的系统法律保护。 关键词:农民经济权益;体系重构;法律配置 中图分类号 :DF452 文献标志码 :A 文章编号 :1672 -8505(2012)侃 -α旧-俑 Connotation and PecuIiarity of Farmers Economic Righ臼 and Interests and Their Legal Protection ZHANG Chang-jian (School 0/ Civü and Commerc归i Law , soωhwest University 0/ Political Science and Law , Chongqi晤， 401120 ,China) Abstract: The absence of legal protection to {a.nne凹rights and interests , especially the economic rights and interests , has become the botùeneck to 由e rural economic development and fa.nners income growth. Al由ough 由e 咀ùrd Plenary Session of the 17th CPC Central Committee has brought forward 也at fa.nners politiω1 ， economic , cultural and social rights and interests should be prot田ted ， specific measures have to be taken to realize the protection of their economic rights and interests in practice , the connotation of 也e economic rights and interests have to be detailed and systematized , and some of the important rights and interests have to be upgraded to le惧1 rights.
