AbstractSince Abstract Since reform and opening up，China’S economic system has been changed from the planned economic system to the market economic system and is gradual ly improved，the education sector has also gradually established the system to adapt to the market economic system．Market economy is legal economy，as one of the market economic entities，universities also need to follow the rule of law．Construction of the University Regulations is one of the important components of the legalization process of Universities．It has important theoretical significance on the construction of university system，and it plays an important role in guiding with management in law and the reform of intemal structure in universities． This article first analyzes the definition and characteristics of the rule of law,the status of legislative of universities，finding that the education laws and regulations in China are uneven，showing chaotic state，not forming a system．Analyzing the differences between educmion laws and regulations，revealing the internal relations between University and the rule of law by defining the concept of university regulations，then proposing the two major objectives of the building of university statue． Second，combing the history of university statue in China，which is divided into three stages：before the founding of New China，before the promulgation of”Educmion Law”and after the founding of New China．after the promulgation of’’Education Law”． Then described the status of charter construction of public universities in our country,on the basis of which，exploring the problems in construction of charter in universities from the text，content，draft，implementation and modification etc．The problems lie in the lack of charter construction experience，lack of knowledge of the University statue，not clear with the legal status of the university statue，and the inadequate legal basis of chapter constitution． Finally,this Finally,this research proposed the strategies to pro
