PAGE PAGE 1 结论质证的主体，在三大诉讼法中，有关鉴定结论质证的主体略有不同。鉴定结 论质证的内容，主要围绕鉴定结论的客观性、合法性以及证据的关联性等几个方 面去进行质证。鉴定结论的质证应遵循直接言辞原则和交叉询问等原则。本章主 要为我国鉴定结论的质证程序的构建提供理论依据。 在本文的第三章对两大法系鉴定结论质证程序进行了比较研究。英美法系的 证据制度将鉴定结论视为专家证言，与证人证言的质证程序相同；法、德等国家 把鉴定结论作为一种独立的证据形式，使用不同的质证规则。通过对两大法系鉴 定结论的质证程序的比较研究，为构建我国鉴定结论质证程序提供参照依据。 文中第四章简要地介绍我国鉴定结论质证程序存在的问题，即形式化比较严 重，并分析造成这种现象的原因。本章主要是为下章重构我国的鉴定结论的质证 程序做准备。 第五章是对鉴定结论质证程序的实证研究。主要阐述了以下几个问题：一、 鉴定结论的准备程序，包括鉴定人出庭质证的启动程序，法庭所应作的准备工作， 以及鉴定人出庭前所作的准备工作；二、鉴定结论质证的程序步骤，大致分为鉴 定人宣读鉴定结论以及介绍鉴定结论的生成程序，询问与交叉询问程序等；三、 鉴定人出庭质证时应注意的问题；四、鉴定人质证时的权利与义务，鉴定人享有 人身和财产受保护的权利，参与法庭询问的权利，以及获得相应报酬的权利；其 义务主要指按时参加法庭质证，并保守相关秘密的义务。 在本文的最后一张，提出完善我国鉴定结论质证程序的几项制度的构建。在 本章提出，需完善民事和行政诉讼中的专家辅助人制度，在刑事诉讼中建立专家 辅助人制度，避免质证程序的形式化；设立庭前鉴定结论的展示程序，让质证的 各方有充足的时间去准备法庭的质证程序；进一步完善鉴定结论的交叉询问程 序，让鉴定结论在法庭上通过当事人的询问与反询问。 在文章的结语部分，阐述了要想建立非常完善的鉴定结论质证的程序，体现 当事人主义的庭审方式，仍有很长的路要走，不仅是要加强相关制度的完善，更 需要一种理念的转变。 关键词:鉴定结论； 质证 ；质证程序 Abstract Expert conclusion,as a form of evidence，is playing an important role both in the criminal investigation and at the trial . Expert conclusion.has the characteristics of objectivity and scientificity,but also includes the subjective component, it is not king of evidence, nor scientific trials, but is a way to prove it. So expert conclusion.must be in court after the parties on cross-examination, then the judge permits the freedom of mind to identificate the facts of the case . Therefore, the process to cross-examine the expert conclusions of a study can not only play better proof of identification of the role of the conclusions, but also the demands of procedural justice. The article tries to make an analysis and research on the cross-examine the conclusions in the identification of specific procedures as well as the expert on how to testify in court for more in-depth study.
