教育公平的宪政价值分析宪法学岛行政法学专业 教育公平的宪政价值分析 宪法学岛行政法学专业 研究生康宇 指导教师杨泉明 教育公平，是全人类共同追求的理想和目标之一。新中国成立50多年来， 教育公平的发展取得了巨大的成就。但由于一些历史和现实的原因，教育不公 平现象仍然存在，并且在某些方面比较严重，引起了人们的极大关注。社会主 义宪政建设给新时期教育公平的发展提出了新的要求并为教育公平的进一步 实现创造了良好的条件。同时，教育公平的实现对于社会主义的宪政建设也具 有十分蓑要的意义。．本文在铁本体论酶焦度分析了教育公平的基本理论和体 系、从认识论的角度研究了教育公平的演变和发展的历史脉络之后，研究的视 角深入到价值论的角度，找出教育公平与法的价值的内在联系，进而寻觅到教 育公平与正义、秩序、民主、自壶、平等、安全等宪政侩值的内在联系。最盾， 本文以宪政为大背景，从立法、执法、司法、宪法意识等方面提出促进教育公 平的对策和思路。 关键词： 教育公乎法价值和宪政价值追求社会主义宪政对策 The The Constitutionalism Value Analysis of Educational Equality Major：Constitutional Law and Administrative Law Postgraduate：Kang Yu Tutor：Yang Quanming Equali锣is one of the goals that mankind is seeking for．Educational equality， as the extension and development of quality concept，is the dream that human society diligently strives after．Although during over 50 years’efforts our country has made great progress in the field of educational equality,the current situation of educational equality in our country is not satisfactory because of many historical and realistic reasons．Educational equality becomes a topic in OUr society more and more．The construction of the socialism constitutional government puts forward a new request for the development of educational equality in the new period，while it also provides good conditions for the further realization of educational equality． Meanwhile，the realization of educational equality has a very important meaning for the construction of the socialism constitutional government． At first，this paper analyzes the basic theories and the system of education equality from the angle of ontology and studies the historical development of education equality from the angle of epistemological。Secondly,the author’view of research goes deep into the angle of axiology and find out the inside contact between education equality and the values of laws．Furthermore，the author succeed in finding out the inside association between education equality and the constitutionalism values，such as justice，order,democrac
