成都理工大学毕业论文设计 PAGE PAGE 5 网络隐私权的法律保护 作者：罗维斌 专业班级：法学2007090202 指导老师：张松 摘 要 近年来，互联网在我国迅猛发展，它给我们的学习生活带来了极大的便利。但是，互联网如同一把双刃剑，它在给我们带来更多的信息分享的同时，由于其本身的开放性、虚拟性、无纸化等特征，也对我们的网络隐私的保护构成了莫大的挑战。本文主要通过对网络隐私权的概念，侵犯网络隐私权的主要形式，以及外国对网络隐私权的法律保护的研究，从而对我国的网络隐私权的保护提出一些建议。 本文通过研究认为，我国在网络隐私权保护方面，首先要注重立法，一方面要明确隐私权的独立人格权的地位，另一方面还要制定独立的网络隐私权保护法规。其次，政府还应该积极引导互联网产业制定自己的行业自律规定。 关键词：隐私权 网络隐私权 法律保护 Legal Protection of Internet Privacy Abstract: In recent years, the internet develops rapidly in China and it brings great convenience for our study and life. But the internet is like a double-edged sword as it becomes a great challenge to our individual privacy because of its own open, virtual, paperless and other characteristics while it brings us more information to share. This paper aims at making some recommendation for protecting internet privacy in China mainly through the study of the concept of infringing act of internet privacy, the forms of infringing internet privacy and the legal protection for internet privacy in foreign countries. Through the study, this paper suggests that in terms of protecting internet privacy, China firstly must pay great attention on legislation, on one hand, we should be sure of the status of the independent personality of privacy; on the other hand, we should formulate separate statute which can be used to protect internet privacy. Secondly, the Chinese government should also actively guide the internet industry to make their own self-discipline provisions.
