香港的规划管理制度及对内地的启示 熊鹏 摘要：当前，内地以“一书三证”为核心的规划管理制度存在与其他相关部门职能重叠，办事流程复杂， 管理效率低下等突出问题。我国香港地区规划管理在高效和严格之间保持平衡：一是多数建设项目无需向 规划管理部门申请规划许可，同时，私人有权主动提起规划局部调整程序；二是规划条件由土地管理部门 出具并咨询规划及其他政府部门，效率较高；三是工程方案是否符合规划由建设管理部门在施工图审查一 并处理，同时建立 “中央处理建筑图则制度”，整合报建事项。上述高效的私人投资项目报建手续是香港 地区能够发挥市场主体地位，激发社会投资活力的关键因素之一，值得内地学习。内地可以借鉴香港地区 经验重塑规划管理体系，废除选址意见书和建设用地规划许可证，规划条件改由土地部门出具，建设工程 规划许可证改由建设部门核发，规划部门以控规局部调整为核心。 关键字：法定图则，规划许可，土地批租，建筑监管 ThePlanningManagement SystemofHongkongandIts EnlightenmenttotheMainland Abstract: at present, the overlap existing in the mainland planning management system as the core and other related department functions, procedures complicated, inefficient management and other problems.
