摘要海峡两岸同属一个中国，同宗同源，是一家人。相同的血脉必然使两岸社会 摘要 海峡两岸同属一个中国，同宗同源，是一家人。相同的血脉必然使两岸社会 在各方面存在相同或相似之处，然而独特的政治因素又使其各有特点。在法定继 承制度上，两岸同样是相似与差异共存。本文拟对海峡两岸法定继承制度进行比 较，找出各自异同之处，并尝试对其进行个人评价，以期进一步探究两岸社会在 对待私有财产、历史传统的继承等问题态度上的异同，也为大陆继承法制度的完 善以及未来民法典的制定贡献自己的绵薄之力。本文共分为四章。第一章对继承 相关概念做了概括性的介绍，并对海峡两岸继承制度的制定、发展和所采原则作 了阐述；第二章较为详细地比较了两岸法定继承具体制度中的差异，使读者得到 一个直观的认识；第三章针对两岸法定继承制度各自特色做出发掘和分析；第四 章尝试对两岸法定继承制度之差异根源进行探讨和总结。 关键词：大陆台湾法定继承比较差异 中图分类号：D923．5 AbstractBoth Abstract Both sides of the Strait shares the same origin and belong to the same family, China．Same blood will inevitably result in many similarities in many ways for both societies，howeveE each society has its own characteristics because of very unique political reasons．Naturally，for legal succession systems of both societies。there are similarities and contrasts as well．This article intends to make a comparison and a contrast of legal succession systems for societies of both sides of the strait，and tries to make personal comments on them。in order to find out different opinions of the two societies hold toward issues like private properties and succession on historical legal traditions，also in the hope of contributing efforts to the improvement of mainland succession system and to the compilation of the mainland‘S futu re civilIaw．This article consists of four chapters．Chapter One gives a general introduction on the concepts of the Succession Law,also studies the formulation。development and the basic principles of the Succession Law system of both sides of the Strait；Chapter Two elaborately compares the legal succession system of both sides of the Strait，and gives the readers a direct perception on them；Chapter Three studies and analyses the unique characteristics of the legal succession system of both sides of the Strait perspectively；Chapter Four tries to discuss and summarize the fundamental reasons for the dliferences of the legal succession system of both sides of the Strait． Key Words：mainland China Taiwan legal succession system compariso
