互联网时代倒卖车票罪的规范解读一一 有偿抢票服务入罪论 高艳东祁拓 浙江大学光华法学院浙江大学光华法学院互联网法 律研宄中心 摘要： 有偿抢票服务的本质是有偿代购，司法实践对倒卖车票罪保护法益的认识存在 误IX，不加IX分地将所有有偿代购车票行为认定为倒卖车票罪。应把倒卖车票罪 的保护法益界定为旅客自由购票的选择权，“倒卖”应理解为以营利为0的贩 卖，无需“先买后卖”。有偿代购行为可区分为劳务服务型和机会垄断型，前者 不是刑法调整对象，后者应被禁止。利用软件实施的有偿抢票服务属于机会垄断 型有偿代购行为，其通过技术优势霸占虚拟购票窗口，侵犯了旅客自由购票的 选择权，应以倒卖车票罪论处。 关键词： 有偿抢票;技术滥用;自由购票选择权;倒卖;机会垄断; 基金：司法部课题“量刑对定罪的反作用力研宄(13SFB2019) ” The Normative Interpretation of the Crime of Tickets Scalping in the Internet Era the Theory of Criminalization of the Paid Service for Ticket Procuring Gao Yandong Qi Tuo Guanghua Law School, Zhejiang University; Abstract： The essence of the paid service for ticket procuring is paid purchasing agent, and the judicial practice has misunderstood about the legal interest of the crime of tickets scalping. So all the behaviors of paid tickets purchasing agent is indiscriminately considered as the crime of tickets scalping. The legal interest of the crime of tickets scalping should be defined as the right to freely choose tickets purchasing for passengers, and the “scalping” should be understood as “selling for profit” without “buying first” and “selling later” ? The behavior of paid purchasing agent can be divided into the type of labor service and the type of opportunity monopoly, the former is not adjusted for criminal law， and the latter should be prohibited. The paid service for ticket procuring implemented by software belongs to the behavior of paid tickets purchasing agent which is divided into the type of opportunity monopoly. This behavior uses its technical advantages to occupy the virtual ticket windows, ancl infringed the right to freely choose tickets purchasing for passengers. It should be punished by the crime of tickets scalping.
