山东科技大学硕士学位论文摘 山东科技大学硕士学位论文 摘 要 PAGE PAGE 1 摘 要 完善石油储备法律体系是保证国家政治、经济、军事安全的必然要求。但当前，我国 石油储备领域的法律法规很不完善，存在很多不足，没有形成完整的石油储备法律体系。 问题就是现有法律法规同国家储备战略不符合，我国需要通过完善法律保障石油储备的 顺利开展。西方发达国家形成石油储备制度，都是立法先行。我国也应依照国际惯例， 加快制定石油储备法律，以便让石油储备制度沿着规范化、法制化方向发展。 本文试从石油储备内涵和石油储备制度出发，从基础理论的角度对石油储备问题进 行深入分析，比较不同种类的石油储备模式；提出有必要用法律手段调整石油储备的现 实需要；依次阐述日本、美国、法国等西方发达国家石油储备法律制度和政策理念，比 较分析各国的立法特点、实践经验，结合我国实际情况，不断吸收、借鉴他国的立法思 路、可行之策，逐步完善我国的石油储备法律体系；通过对我国石油储备的立法现状和 加快法制建设必要性的分析，探索石油储备法律的基本原则、基本内容等问题，提出石 油储备法律体系的基本框架：以《能源基本法》为核心，围绕《石油储备法》和《石油 安全法》展开，同时制定配套的法规条例，让专项法律同配套法规相互配合，形成适合 我国国情的石油储备法律体系。 关键词：石油储备；法律制度；立法建议 山东科技大学硕士学位论文AB 山东科技大学硕士学位论文 ABSTRACT ABSTRACT To guara ntee the countrys politica l, economic, and military security, oil reserve lega l system must be further improved. At present, the oil reserve law of our country is not very complete, has ma ny deficiencies, the complete petroleum reserve lega l framework has not formed. Problem is that exist ing laws and regulations do not meet with the nationa l reserve strategy, in order to ensure the development of oil reserve, China needs to further improve the lega l. Formation of petroleum reserve system in Western developed countries, all legislate first . China should also be in accordance with internationa l practice, speed up the formula tion of laws on oil reserves, in order to let the petroleum storage system develop along the standardization, lega l direction. This text tries proceeding from oil reserve intension and petroleum storage system, analyze in depth the oil reserve question in terms of basic theory, compare different types of oil reserve modes; propose that it is necessary to adjust the oil reserve by lega l mea ns; expla in lega l system and policy idea of wester n developed nationa l petroleum reserve such as Japan, U.S.A., France sequentially, compare and analyze legislative character ist ic and practica l exper ience of various countries, combine the actual conditions of our country, absorbing and drawing lessons from legisla
