I I 摘 要 婚姻家庭是构成人类社会的基本单位，夫妻关系是否和睦影响着和谐社会的 构建。当前中国连续飙升的离婚率影射出夫妻之间大量侵权行为的存在与不和谐 的婚姻家庭关系，亟需构建科学合理的婚内侵权民事责任制度。本文拟分为四部 分对婚内侵权相关的法律问题进行论述： 第一，通过介绍国内典型的案例，对案例进行深度分析，引出本文所要阐述 的核心问题：是否应该构建婚内侵权民事责任制度。围绕该问题，学界存在“否 定说”、“肯定说”与“折衷说”三种学说，笔者对不同观点的主要理由进行阐述， 同时提出本文的看法。 第二，讲述婚内侵权民事责任制度的演进。分别介绍英美法系国家、大陆法 系国家对婚内侵权问题从豁免到承认的经过，并分析我国相关立法的发展进步以 及现行法律的不足之处。 第三，介绍婚内侵权民事责任的基本理论。解释婚内侵权的概念及其特殊性； 具体阐述婚内侵权行为的类型及表现形式。进而从归责原则、构成要件、责任承 担方式等方面对婚内侵权民事责任进行了详尽分析，从侵权法的角度阐明婚内侵 权行为的本质。 第四，构建婚内侵权民事责任制度的探析。本文从婚姻家庭法、侵权责任法 等不同法律部门对婚内侵权民事责任制度的构建提出了可行性建议。 关键词：婚内侵权行为，婚内侵权民事责任，损害赔偿，夫妻财产制 II II Abstract Family is the basic unit of human society. Whether the marriage relationship is harmonious or not affects the construction of a harmonious society. Recently the roaring divorce rate in China reflects the existence of torts between couples as well as discordant family relationships. Consequently, a scientific and reasonable marital tort civil liability system is of urgent need. The thesis consists of four sections illustrating law issues concerning marital torts: First, with description and depth analysis of typical cases in China, the thesis introduces the core issue – whether or not the marital tort civil liability system need to be constructed. There are three theories concerning the issue which are ‘Approval’, ‘Opposition’, and ‘Neutrality’. The thesis illustrates reasons of each theory and introduces new views. Second, this part describes the evolution process of marital tort civil liability system, including the process from exemption to acknowledgement of marital tort in US legal system, UK legal system and China legal system. Next, the paper analyzes the improvement of related legislation in China and the flaws of current law. Third, The thesis demonstrates the basic theory of marital tort civil liability, explains the conception and characteristics of marital tort, and illustrates types and patterns of manifestation of marital tort.
