华东政法学院 硕士学位论文 民国亲属法浅探 姓名：顾微微 申请学位级别：硕士 专业：法律·民商法 指导教师：丁凌华内容提要本文讨论了从清末修律到南京国民政府民法的颁布这一历史阶段中，中国亲 内容提要 本文讨论了从清末修律到南京国民政府民法的颁布这一历史阶段中，中国亲 属法的制定和发展状况。始于晚清的变法修律运动，使相沿数千年之久的中华法 系随着中国封建社会的分崩离析而退出了历史舞台，取而代之的是西方资产阶级 的法律体系。中华民国建立以后，沿着清末修律开创的法律近代化道路继续前进， 并最终完成了中国传统法律向近代化的转型——南京国民政府六法全书的颁布 实施。与此同时，在亲属法领域也达到了近代以来的最高成就即《中华民国民 法·亲属编》。 本文选择近代亲属法这一研究课题，是因为对该课题的研究既有历史价值又 有现实意义。基于这一认识，本文试图在梳理与分析近代亲属法的制定历程和基 本内容、特点的同时，发现其中可资我国现行婚姻法制建设借鉴的地方。 本文共分三章。第一章为民国时期亲属法制定的成因及演变。该章回顾了我 国传统亲属法的内容和特点，阐明了近代亲属法制定的原因，详细介绍了近代亲 属法的制定历程。第二章为《中华民国民法·亲属编》的基本内容及其对传统制 度的改造。该章从亲属制度、婚姻制度、家庭制度三个方面详细介绍了民国亲属 法的基本内容并对其特点进行了分析。第三章为民国亲属法对我国现行婚姻法律 制度的借鉴意义。该章指出了我国现行婚姻法的不足和空白，同时阐述了对现行 婚姻家庭法修订的一些设想。 AbstractThis Abstract This Pap}er discusses the forlTlulation and its development of China’s law of domestic relation during the period from the law amending at the end of Qing Dynasty to the promulgation of the Civil Law by the Nanjing Kuomintang Govermnent．With也e disintegration of China’s feudal system．the traditional Chinese law system．which had lasted for thousands of years．gave way to the W÷stem bourgeois lave system．The law refomling and amending movement beginning from the end of Qing Dynasty continued afier the establishment of the Republic of China。 And with the promulgation and implementation of the Pandect of Six Laws by the Naniing Kuomintang Goverrmaent，the transformation and modernization of China’s traditional law was finally completed。In the meantime．the Domestic Iklation Chapter written in‘the Civil Law of the Republic of CKha’marked the highest achievement in the development ofe硝na’s law ofdomestic relation in modem times． The research of modem 1aw of domestic relation is of both historic significance and current significance，Based on this knowledge．while giving in—depth analysis协 the course of making．fundamental contents and characteristics of modem law of domestic relatiOll．suggestions will be made in how we carl use this experience for reference to help our current marriage law construction． T1
