中文摘要中文摘要 中文摘要 中文摘要 应否设置仲裁第三人制度的争议由来已久，国际范围内学者们所持观点分歧 很大。我国目前尚未建立仲裁第三人制度，但是，随着经济关系日趋复杂化，仲 裁实践中涉及到第三人权益的案件时有发生，第三人制度的缺失引发了很多问题。 某些当事人在仲裁中虚构事实、证据，合谋损害第三人利益，或利用仲裁协议对 案外人无约束力的特点，转移财产，规避法律责任。文章通过分析仲裁实践中的 典型案例入手，探索仲裁第三人制度涉及的基本问题。在分析评述相关理论争议 的基础上，结合实践论证了我国建立仲裁第三人制度的必要性。仲裁第三人制度 不仅符合仲裁理论的基本要求，也能够为仲裁实践的发展提供必要的制度保障。 建立仲裁第三人制度契合了仲裁制度的自治性、民间性及经济性等特征，是彻底 解决案件实体争议的有效途径。意思自治原则的相对性、仲裁协议效力的扩张性 等理论都为仲裁第三人制度的存在提供了理论基础。通过对国际范围内第三人立 法模式的比较分析，文章指出，结合我国仲裁的实际情况，应当作出直接立法模 式的选择；文章进一步探讨了仲裁第三人加入程序的条件、时间、方式以及相关 的权利义务，并从冲突解决机制以及事后救济制度等方面讨论了相关的救济机制， 力求在仲裁程序中能够充分保护仲裁各方当事人的合法权益，促进仲裁第三人制 度的健康发展。 关键词：仲裁第三人仲裁协议救济途径 万方数据 JIlll JIlll I I II Il ll Illl ll III Y2770465 黑龙江大学硕士学位论文 Abstract There are still some debates on the issue that whether the system of‘the third party in arbitration’is necessary to set up．The international scholars have different views on the problem．With the rapid development of market economy,the cases concerning the third party’S right are frequently found in the practice of arbitration．The lack of the third party legal system has caused many problems．Specific behavior is in the process of arbitration， fictional facts and evidence，the conspiracy of relative parties will damage the third party’S interest．The relativity of arbitration helps the relative party to transfer assets or avoid liability．This paper aims to explore the basic problems of‘the third party in arbitration’ basing on the typical case．The system of‘!the third party in arbitration’’not only meets the requirement of arbitrational theory,but also provides safeguards for the practical development of arbitration．The establishment of the system of‘the third party in arbitration’coincides with autonomy,civil and economics of arbitration．What is important is that this institution is the most efficient path to solve the substantial issues．The relativity ofthe principle ofautonomy ofwill and the expansionary ofthe effectiveness ofarbitration agreements both provide theoretical basis for the existence
