摘 摘 要 第 第 i 页 摘 要 马克思的历史唯物主义法哲学以社会存在论为基础，运用历史唯物主义方法 论，对传统法哲学关于法的起源思想、法的现实基础、法的本质及国家与个人的 关系等问题进行了科学的揭示、阐释，以及对资产阶级的“自由、平等”法权观 进行了彻底地批判，重构了“自由、平等”法权，实现了法哲学的历史性变革。 马克思把法的现象放置于社会大系统中来加以考察，深入分析法和法律与社会经 济生活条件之间的相互关系，从而正确揭示出法的起源、法的现实基础和本质； 马克思从揭示人的本质问题入手，提出了人的社会性与社会的人性之内在统一的 重要思想，阐明法和法律是个人的社会化和社会的人性化的工具，从而彻底消除 了千百年来西方哲学家在个人与国家关系问题上所制造的“二律背反”；马克思 划清了与传统法哲学、各种空想主义者之间的原则界限，对“自由、平等”的现 代法权保持一种批判性和建设性相结合的辩证理解，并深刻揭示现代法权的异化 性质及其形式化、抽象化特征，提出从“政治解放”到“人类解放”的思想。 马克思对传统法哲学的批判与超越不仅实现了法哲学史上的一次革命，而且 蕴含了一种新的法哲学观的形成和一种新的法哲学方法论的产生。马克思的法哲 学思想对我国现代法权制度建设具有重要的启示作用和实践价值。 主题词：马克思，法哲学，革命，探析 AB ABSTRACT 第 第 ii 页 ABSTRACT Marxs historical materialism legal philosophy on the basis of social ontology, using historical materialism methodology, the traditional law philosophy thinking about the origin of law, the essence of realistic foundation, the method, the relationship between state and the individual problems such as the scientific reveal, interpretation, as well as to the bourgeoisies freedom, equality the concept of law has carried on the thorough critique, reconstructed the freedom, equality of law, and realized the historic change of law philosophy.
