DO I :10.16290/.cnki .1674 -5205.2007.02.007 2007 年第2 期　　　　　　　　　法律科学(西北政法学院学报)　　　　　　　　　　　　　·　57　· 　:1671-6914 (2007)02-0057-(15 ) 何生根,周　慧 (中国政法大学, 北京 102249) 〔　〕　学术自由的法律界限有哲学和伦理学上的依据。历史上有关学术自由法律界限的学说主要有绝 对自由说、限制行为说和限制利益说。 对学术自由的客 限制主要来自于某些法律价值, 即学术自由应以 个体权 利、公共利益和国家利益为界。 个体权利成为学术自由的法律界限主要是指教师的权利、学生的权利和机构的利 益对学术自由行为的限制。学术自由权利社会化使学术自由权利主体间的侵权行为日益突出, 主要表现于著作 权、人格权对学术自由行为的限制。公共利益的界限主要表现在公共秩序与安全对学术自由行为的限制。 国家利 益的界限主要表现于国家安全利益对学术自由行为提出的必要限制。 〔〕　学术自由;法律界限;个体权利 Abstract:Leg al limits of academic freedom have a philosophical and ethical foundation.Historically, the doctrine of absolute freedom, doctrine of restricting behavior and do ctrine of restricting interests are the main doctrines of legal limits of academic freedom.Ob ective limits of academic freedom are mainly co me from some leg al interests.In o ther w ords, the academic freedom should be conf ined by individual rights, public interests and natio nal interests.I ndividual rig hts, being the legal limits of academic freedo m, ref er to the f act that teacher s right, students rig ht and institutional interests re- strict the behavior of academic freedom.T he right socialization of academic freedom induces tor tuous behavio rs betw een the right sub ects of academic freedom.The limits of public interests mainly manif est in the restriction of public order and public saf ety on academic freedom.The limits of national interests mainly manif est in the necessary restriction of national safety interests on academic freedom.
