AB AB STRACT The spread of piracy in new century threatens the global marine trade and influences the development of global economy．In current situation，the country could hardly bear the financial consumption of striking the piracy,have the ability to strike pirate county,or neglect this problem or the countries in need of aids．Beyond doubt，most treading countries in the world don’t have sufficient energy or long．term plan inwardly to make preparations for striking the pirate with domestic law． In order to avoid the domestic jurisdiction,some countries extradite the pirates captured to the third-party country with the form of agreement， which is to make the third—party country exercise jurisdiction．Such cheap and convenient pattem has obtained certain effect．However,because the countries who sign the agreement didn’t meet their promise，the third。party country is not willing to assume the responsibility any more． United Nations Security Council passed No．1 85 1 resolution on Dec 1 6 th，2008．It appealed the countries to strike the pirates along the shore of Somalia．Some countries dispatched the warship，which played a role of shocking and awing to the Somali pirates．However,most warships just drove the pirates．Even they captured the pirates，they were seldom brought to trial．Therefore，the method did not resolve the problems of prosecuting the pirates fundamentally． Establishing the global anti-pirate intemational court will obtain good result both in the saving of cost and expenses and the professional skills．For this purpose，Pan Jiwen，the Secretary General ofthe United Nations，listed 7 proj ects for the deliberation of the United Nations II Security Security Council on July 26 th，20 1 0．Establishing the global anti。pirate thintemational court can solve the problems that the countries are not willing to exercise jurisdiction．Meanwhile，it can also solve the defects that the countries do not prosecute the pirates because of financial problems．Thus，establishing the glo
