Methods: Based on the fundamental theory of Confirming non-infringement action , using case analysis，legal analysis，economic analysis and policy at home and abroad analyzed and contrasted, anatomize the legal system of confirming non-infringement action in China. Result and Conclusion: I According to the national intellectual property strategy and combining with the actual level in the pharmaceutical industry, widen the accepted conditions for the non-infringement Action of Intellectual Property , increase the availability of drugs. Key word：Pharmaceutical patent，non-infringement action of intellectual property， The national intellectual property strategy 引 言 不侵权诉讼是我国知识产权领域发生的一种日益增多的新型诉讼。与普通侵权诉讼不同，它是当知识产权权利相对人的权益受到损害，主动诉请法院确认自己的行为不构成侵犯权利人的权利，以消除相对人不稳定的权利状态，避免其利益受损害的一种诉讼①。 近年来，不侵权诉讼案件的法院受理量逐年增加,而发生在医药行业的若干不侵权诉讼案件更是引起了全社会的广泛关注。不断完善专利法充分保障了药品专利权人的权益，但却没
