论程序正义宪法学与行政法学专业 论程序正义 宪法学与行政法学专业 研究生刘卫国 指导老师杨泉明 摘要：法的实现是通过法律适用的结果和产生这一结果的程序。一般来说， 虽然结果和程序有不同的价值，程序并非从属于结果，有其自身独立价值，但 二卷从总的来说是和谐统一的。也就是说，正当的程序是产生合法结果的前提 条件。但二者有时也存在冲突，也就是说，违法的程序也可能产生正确的结果。 近年来，学术界对于“重实体，轻程序”等错误做法予以批评，呼吁重视程序 的独立价值，但仪停留在重视程序的菲工具憔价值的问题上还远远不够，应当 设计如实现程序正义的法制途径，使程序正义落到实处。正是基于此，本文拟 通过阐述程序正义的基本问题，追溯程序正义的发展历史，就我国的国情，寻 求程序正义实现的思想保障，探求程序正义实现的制度保障，完善有中国特色 的社会主义法律体系。全文的核心是研究探讨了关于程穿正义实现保障的闻 题。以实现程序正义为根本目标，探索实现程序正义的新方法、新途径，提出 建立思想保障和制度保障，促使程序正义以渐进式的、多元化的方式逐步影响 我们的社会，最终成为中国的“法治精神。 关键词：程序正义程序正义思想保障制度保障 on on the Procedural Justice Major：Science of Constitutional and Administartvie Law Postgraduate：Liu Wei—guo Tutor：Yang Quan-ming Abstract：The law is realized by the result of the law and the procedure to produce it．Commonly,though result and produce have different value，procedure isn’t subj ect to result，it has independent value of itself,but totally they are harmonious and uniform．Namely，fairly procedure can produce legal result．But sometimes conflict exists between them，namely，illegal procedure can produce correct result too．In recent years，the academy criticized some mistake as“regard entity，despise procedure”，they appeal to regard independent value ofprocedure， but it is not enough to settle on the problem of regarding the uninstmmental value ofprocedure．We should design jury route ofrealizing procedural justice，SO as to procedurM justice could be come out．Based on it，the paper plans to ascend development history of procedural jusfice through expatiating basic problems of procedural justice，seek idea safeguard of realizing procedural jusfice and search system safeguard of realizing it as to Chinese situation，furthermore，perfect socialistic law system which has Chinese characteristics．The core of the whole paper is investigating the problem about achieving the procedural justice．In order to achieve the procedural j ustice，we should search the new method，establish the thinking methodology and system methodology，make the procedural justice affect our society step
