J . 「刁 遗 嘱 执 行 人 制 度 是 继 承 法 中 的 一项 十 分 重 要 的制 度 。各 国 民法 大 都 对 遗 嘱 执 行 人 制 度 做 了详 细 的 规 定 ，我 国在 继 承 法 中也 确 立 了遗 嘱 执 行 人 制 度 ，但 是 内容 非 常 的 简 单 ，远 远 不 能 满 足 司 法 实 践 的 需 要 。因 此 ，很 有 必 要 加 强 对 遗 嘱 执 行 人 制 度 的研 究 ，来 完 善 我 国 的 遗 嘱 执 行 人 制 度 。按 照 继 承 法 的基 本 原 理 ，遗 嘱 于 遗 嘱 人 死 亡 后 才 能 发 生 效 力 。因此 ，遗 嘱 人 自己 不 可 能 执 行 自己 的遗 嘱 ，而 须 由他 人 来 执 行 。而 且 ， 由他 人 执 行 的 “遗 嘱 ” ，是 否 是 遗 嘱 人 的真 实 意 思 ，须 首 先 依 一 定 程 序 予 以确 定 。所 以 ，各 国继 承 法 大 都 规
