摘要我国石油行业的垄断形成由来已久，国家通过行政垄断的手段对石油资源这 摘要 我国石油行业的垄断形成由来已久，国家通过行政垄断的手段对石油资源这 一能源资源进行严格的掌控，以保障国家的安全。然而随着我国石油行业的不断 发展和计划经济向市场经济的转轨，石油行业原有的运行机制渐渐开始显露出一 些弊端，不利于未来我国石油行业的发展。本文主要研究我国石油行业垄断的特 殊性以及如何通过立法手段对垄断加以规制。 全文分为四章：第一章是石油行业垄断的法律问题的概述，从宏观的角度论 述我国石油行业垄断的结构、具体表现以及形成的历史原因，并从法律的角度分 析我国石油立法的体系和缺陷，立体的呈现出我国石油行业存在的现实问题和法 律问题，并论及入世后我国石油行业所面临的挑战。 第二章是对我国石油行业垄断与竞争的取舍进行价值判断。分别探索在我国 特殊的国情下，石油行业中存在垄断的价值以及引入合理竞争机制的价值，分析 出垄断和竞争对我国石油行业的不同意义，并寻求合理的途径对其不同的价值加 以平衡。 第三章主要针对各国不同的石油立法模式和我国烟草行业的立法模式进行 分析。从世界范围内选择在石油立法方面具有代表性的国家，包括对美国、英国、 日本、委内瑞拉等国家的立法模式和优点进行分析，与我国石油立法进行比较， 寻求可借鉴的经验。同时对烟草行业这一国家专营专卖的行业的立法进行分析， 为石油立法寻找可以遵循的思路。 第四章是对《反垄断法》第七条的评析以及对构建我国的《石油天然气法》 的一些设想。通过对《反垄断法》第七条的评析，分析其对我国石油行业的影响。 提出从主体资格、监管体制和上下游分开的方式构建石油天然气法的建议，来实 现对我国石油行业的统一反垄断法律规制，并寻求《反垄断法》和《石油天然气 法》的相互配合。 关键词：垄断； 法律规制； 《石油天然气法》 ABSTRACTThere ABSTRACT There is a long history ofthe formation ofmonopoly ofthe oil industry in China． Bec硼se oil is a very important energy resource，the government controls戗le oll resources strictly by administrative monopoly to protect national security．However， along with the development of China’S oil industry and the economic transition from pl蛐ned economy to market economy,the original operating mechanism of oil industry starts to reveal some shortcomings．This kind of operating mechanism is not conducive to the future development of China’S oil industry．This paper studies on the special nature of China’s monopoly of the oil industry and how to regulate monopoly by legislation． The paper is divided into four chapters：The first chapter is all outline of legal issues about the monopoly of the oil industry,for example the structure of China’S monopoly of the oil industry,specific performance and the historical reasons．This paper analyzes the system and China’s petroleum legislation defects from a legal point of view,and shows the realistic problems and legal issues of China’S oil industry． Then it talks about the challenge to the China’S oil industry aRer the accession to WTO． The second chapter is
