摘 摘 要 今天，中国人比任何时候都更加意识到法治对政治生活和社会 生活的必要性和重要性。围绕司法审查所展开的若干问题的讨论， 都涉及法治含义中权力的配置和制约，都关系权利的保障和实现。 而WTO法律规则是近年来理论界研究的热点问题，司法审查制度也 不例外。过往理论研究的视角或放在规则本身、或结合某一具体部 门法来研究WTO规则，结合规则研究某一具体制度的则比较少。有 鉴于此，本文以WTO规则审视我国司法审查制度。 文章首先探讨WTO协议中司法审查的本质与特征，这种探讨以 概念分析为基点，对司法审查的概念进行了理论分析，再从WTO协 议中的有关条文引出司法审查在WTO协议中的本质与特征，然后结 合我国加入WTO议定书中关于司法审查的承诺内容，重点分析具体 承诺的特点、承诺的原因以及承诺的外部约束。 抽象地分析我国的承诺之后，文章接着对我国司法审查的现状 进行分析，认为审查主体缺乏实质上的独立、审查范围狭窄、审查 标准缺失、诉权保护不力、裁判终局性得不到保障等，是制约我国 司法审查制度发展的重要因素。 通过实证分析，找出了现行审查制度的主要缺陷和不足。文章 接着将这种不足置于WTO规则视角下进行分析，并结合我国的承诺， 力足于理论服务于实践，提出了完善司法审查制度的具体对策，认 为：构建中国特色的审查模式是完善司法审查制度的重要依托；合 理配置审查权力是完善司法审查制度的关键环节；完善相关立法是 司法审查制度完善的现实途径。 关键词：WTO司法审查行政法院 AbstractChina Abstract China has real ized the necessity and importance of the rule of law to the political and the social 1ives today．Every discussion on judicial review has involved in the disposition and restriction of the powers and the guaranteeing and realization of the civil rights．WTO legal rules have been the hot issue，which iS studied in the theory Circles in recent years，and SO iS the judicial review system．While doing theoretical research on the WTO legal rules，most people usually focus on the rules themselves or do it by combining some specific branch Iaw，however，few people study some specific system by combining the rules．Therefore，the essay studies China’S judicial review system from the visual angle of WTO rules． The essay has probed into the essence and character of {udiCial review firstly．On the basiS of concept analyzing， the diSCUSSion has carried on a theoretical analysiS about the concept of judicial review，and seek the character of judicial review of WTO agreements from concerning articles of WTO agreements．Then from China’S promise on judicial review in Entering WTO Agreement，focuses on the content and reasons and outer restriction of the specifiC promise． After analysing the China’S promise abstractly，the artiCle coatinues to have carried on the analysiS present situation of our country’S jud
