摘要本文所研究的地方立法计划，是关于省、直辖市人大常委会 摘要 本文所研究的地方立法计划，是关于省、直辖市人大常委会 在一定时期内制定、修改、废止、批准地方性法规等规范性文件 的方案。地方立法计划属于工作安排。从制定主体、程序及其内 容等方面看，地方立法计划不是“半法”或“准法”。按照时限，可 将地方立法计划分为短期、中期、长期三种：按内容，可以分为 综合性地方立法计划与专门地方立法计划；按实施情况，可以分 为拟出台的地方立法计划和调研论证的地方立法计划；按效力， 可分为省(市)本级立法计划和全省(市)立法计划。地方立法 计划区别于国家立法训‘划，具有地方性、配套性、灵活性、多级 性。地方立法计划与其他工作计划相比，具有政治性，交涉性、 系统性、公开性。地方立法计划具有计划功能、指引功能、系统 功能、链接功能。制定地方立法计划应遵循合法性原则、可行性 原则、科学性原则。地方立法计划是对一定时期内地方立法项目 的安排，关系到人大及其常委会立法权的行使，具有全局性和长 期性的作用，应当由负责处理常委会重要日常：Ij作的主任会议制 定。制定地方立法计划要认真搞好前期准备工作、征求项目工作、 项目整理工作和形成计划时的相关工作。地方立法计划的实施程 序 般包括印发、各实施单位(起草、提案、修改、审议单位) 依据计划按立法程序进行立法、主任会议协调、督促和常委会总 结等几个阶段。由于多方面的原因，地方立法计划的实施率不是 很高。地方立法计划由主任会议决定可以进行调整。要完善地方 立法计划工作，首先要突出重点解决“拼盘”问题，其次要搞好 前期准备避免被动应付，最后是增加听证程序夯实民主基础。 关键词：地方立法计划人大常委会主任会议 AbstractThe Abstract The local legislative plan studied in this article is a programme about which the standing committee of provincial people’s congress in a certain period constitutes，modifies，abolishes and grants local code．Of course，this legislative plan belongs to arrangement．But，if seen from the aspect of its subject，procedure and content，the local legislative plan is not half law or would—be law．This plan can be divided into short-term，middle—term and long-term in the light of time limitation．According to its content，the plan can be divided into comprehensive local legislative plan and special local legislative plan． According to its enforcement，it can be divided into plan of drawing-up local legislative and investigating local legislative．In view of its effect，the legislative plan can be divided into plan of its own and plan of the whole province．As a matter of fact，being different from state legislative plan，local legislative plan has the characteristic of locality,consistence，flexibility and multi—levels． Compared with other work plans，local legislative plan is political， negotiating，systematicandpublic．Inaddition，locallegislativeplan has the function ofprogramming,guiding，systematic and connecting． Therefore，enacting such a plan should be lawful，
