摘 摘 要 反倾销司法审查制度是反倾销的基本救济制度。WTO反倾销 协议第13条对各成员国国内立法建立反倾销司法审查制度提出了 明确要求。美国和欧盟反倾销立法均规定完善的反倾销司法审查制 度。我国虽然已经通过一些有关反倾销司法审查的法律法规，但是 这些法律法规都很不完善。 我国已加入WTO，完善我国反倾销司法审查制度十分必要。 一方面维护反倾销调查机构所作的正确裁决，保护我国工业免受外 国产品倾销，另一方面纠正一些违法的反倾销措施，赋予反倾销利 益相对方司法救济权。 本文在阐述反倾销司法审查制度基本概念的基础上，对WTO、 欧盟和美国反倾销司法审查制度作了比较深入的分析，阐述了对 WTO反倾销司法审查条款的正确理解、WTO反倾销规则在国内法 院的适用以及内国反倾销司法审查与WTO争端解决机制的关系。 指出了欧盟和美国反倾销司法审查制度在司法审查管辖、司法审查 的标准和司法审查的判决方式及效力的特点。使我们对国际反倾销 司法审查制度有个比较全面的了解，然后通过我国反倾销司法审查 制度与欧美反倾销司法审查制度的比较，找出我国反倾销司法审查 制度与国际反倾销司法审查制度的具体差距，提出了完善我国反倾 销司法审查制度的有益建议。 关键词：反倾销、司法审查制度、 比较研究、立法完善 AbstractThe Abstract The judicial review of the anti．dumping is a basic relief system of the anti·dumping．WTO anti-dumping agreement has put forward the clear request for its members to set up the system of the anti-dumping judicial review in its 1 3th．U．S．A．and European Union have legislated to stipulate their perfect systems of anti—dumping judicial review． Though our country has already passed some relevant anti-dumping laws and regulations on anti-dumping judicial review，they are not very perfect． Our country has already entered WTO and it is necessary to consider perfecting the judicial review of anti—dumping of our country SO as to M maintain the correct decision from anti—dumping investigation organization and protect industry of our country from foreign products dumping’S destroying and Correct some illegal anti—dumping measures and offer anti—dumping interested party to relieve right． On the basis of explaining the basic conception of the anti-dumping iustice review，the text makes a relatively deep analysis of WTO， European Union and American anti-dumping judicial review，gives the correct understanding of WTO anti-dumping clause，the application of WTO anti．dumping rule in its members and the relationship of WTO anti．dumping rule and WTO dispute一-solution system，points out the characteristics of review standard and judgment way and also effect and administration of iustice in European Union and American anti-dumping {udici
