中文摘要关键词： 中文摘要 关键词： 电子数据交换 证据法 管辖权 国际贸易 r电脑是人类二十世纪最伟大的发明，随着电脑的发明，人类的生活方式、法 ，，一枷念及法律关系深受影响。由此衍生出之法律问题更是日新月异，值得加以探 讨。 电子数据交换(EDI)是结合电脑与通讯科技的成果，由参与贸易的相关主 体间，透过直接连线或加值网路服务，以电子方式传送协定的标准格式资料，取 代传统的纸张贸易，有效降低传统贸易所产生之传送迟延、失窃、伪造及人工处 理错误的发生率，并节省可观的交易成本。了 本文主要以电子数据交换对传统国际贸易所造成之冲击及衍生出之法律问 题为研究对象，目的在于消弭因推动电子数据交换所产生之法律障碍。前段部分 将兼论目前国际上电子商务的现况及立法，从而正式切入本文的主题。但限于篇 幅及个人研究方向，仅就书面形式、电子签章、证据法及管辖权法律适用等法律 问题加以探讨。 本文第一章：国际贸易合同之新议题 说明电子化国际贸易的特色及与传统贸易之差异、并介绍当前国际上之立法 现况。 第二章：电子化对国际贸易合同法治的影响 介绍电子数据交换发展的背景、衍生出之法律问题及阐述与电子商务之异 同。 第三章：纠纷处理 针对电子数据交换引发之书面、签章、要约承诺、合同成立时点、管辖权及 法律适用等问题作深入浅出的分析及论证。 第四章：结论 综合前述，归纳整合数点意见，期望对于推动电子数据交换有所助益。 AbstractKey Abstract Key words：EDI，rules of ex4dence，jurisdiction，international trade Computer is the greatest invention of mankind in 20m century．Thanks to the invention of the device，mankind’S way of living，legal thinking and relationship ale deeply affected．Legal issues arising from these have been changing with each passing day．So there is something valuable needs discussing here． Electronic Data Interchange(EDI)is the achievement of the combination of computer and communication technology．It replaces the traditional paper-based trade，effectively reduces the chances of transfer delay,loss，fabrication and artificial mistake，and saves a considerable sum oftransaction cost． This article mainly studies the impact of EDI on the traditional international trade，and legal issues arising from it，and intends to remove the legal obstacles in promoting the development of EDI．The first part also discusses the current situation and legislation in the fields of international electronic commerce，and get down to the main topic of this article．But this article only studies the legal issues concerning written form，digital signing，law of evidence and jurisdiction due to the limitation of the author’S field of study． Chapter l：new topic of international trade contract． It It clarifies the features of international trade and its difference between traditional trade，and introduces the curr
