摘 摘 要 建设法治国家是人类社会的理性选择和追求。而要建设法治国 家，就必须确立法律至上的原则，在法律制度下用权力制约权力， 以保障公民的基本权利：就必须建立完备和独立的司法制度，以实 现对权力的制约和对权利的保障；就必须重视和强化检察制度，以 保证公正司法。检察制度与现代法治密切联系，息息相关。 “ 检察制度适应现代法治的需要而产生。在人类文明演进史上， 司法制度的形成和发展经历了由国家审判代替私人复仇，再到国家 职能中司法权从行政权分离出来，构成专门的司法机关和司法制 度，然后在司法制度中审判与检察相分离，形成检察制度这样的自 然进程。这个进程的最终决定力量来源于现代法治的发展状况和内 在要求。 检察制度的基本功能实质上是对社会的控制作用，即对法治秩 序的实现与保障，主要包括追诉犯罪、保障人权、维护公益及公正 司法等几个方面。 为推进法治，必须改革和发展检察制度。不同类型检察制度之 间的相互借鉴与融合，检察机关职能的强化和检察官管理制度的完 备，成为当今国际检察制度改革和发展的主要趋势。我国检察制度 的改革总体上要遵循法治原则，要适合我国国情，要循序渐进地分 步骤进行，真正建立起有中国特色的检察制度。 关键词：现代法治检察制度改革发展 AbstractConstructing Abstract Constructing a country ruled by law is the rational choice and goal of human society．But the beginning of ruling nation by law，we must establish the principle that law is the paramount；under the legal system use the power to restrict power,to secure the basic rights of citizens； build a complete and independent judicial system to restrict the power and protect the rights；pay much attention and consolidating the procuratorial system to guarantee a judicial justice．There is a closely relationship between the procuratorial system and the modertl,rule of 1aw． The procuratorial system itself grew out of modern rule of law， and it should meet the needs of rule of law．On the history of human civilizing，the formatting and developing of judicial system passed through several stages：official adjudgement replaced the private reVengeou“sdiction departed from administration in the function of country，formed the special judicial institutions and system；then in the j udicial system itself,judgement departed from prosecution，and procuratorial system formed at last．The decisive power of this ibrmulating course originated from the current situation and immanent requirements of the modem rule of law． Procuratorial system is a very important part of the organism that constitutes the power of society contr01．Its basic function of realizing and preserving the order of the rule of law，mainly includes：to prosecut crlme，to protect
