内容摘要内容摘要 内容摘要 内容摘要 目前，关于在我国刑事诉讼中是否应当确立沉默权制度的问题，已成为刑 事诉讼法学界、司法实务界以及社会各界普遍关注的焦点。笔者认为，沉默权 作为犯罪嫌疑人、被告人的一项重要权利，应该在立法上明确。但鉴于中国的 国情，当前我国还不宜全面确立沉默权制度。本文就是通过对沉默权的探讨与 解析，为建立有中国特色的沉默权制度提出合理性建议。 本文共分为四个部分。 第一部分，沉默权的概述。该部分从“沉默权的概念及特征、“沉默权的 理论基础”以及“沉默权的争论及其理由”等三个方面对沉默权进行了阐述。 第二部分，两大法系主要国家沉默权的历史演变及比较。从英美法系和大 陆法系的角度，对沉默权的历史演变进行了简要论述，并指出了两大法系及主 要国家中沉默权的主要区别。 第三部分，我国目前沉默权的现状及其未确立的原因。本部分深入分析了 中国的现实国情，指出我国传统的文化观念、社会治安现状和现行法律制度等 对中国沉默权的构建有着重大的消极影响，对此必须高度重视。 第四部分，沉默权制度在我国的构建。在这一部分，笔者首先论证了我国 构建沉默权制度的必要性和可行性，然后提出了建立有中国特色沉默权制度的 构建方案，最后为确保沉默权制度在我国的顺利实施，提出了与其相关的配套 制度的完善。 关键词：沉默权刑事诉讼制度构建 AbstractAbstract Abstract Abstract In recent years，the problem of whether we shill establish the right of silence in Criminal Procedure in China has already become the focus in the criminal procedure academic，Justice practitioners，as well as the general community．As an important right of a criminal suspect or the accused person，right of silence should be clear in the legislation．Considering China’S national situations，it is still not fully established the right of silence at present．This article shows the reasonable suggestions of how to establish the systems of right of silence with Chinese characteristics through discussions and analysises． The article consists of four parts． Part l：the overview of right of silence．This section carl be divided into three aspects，which make a brief description about the right of silence．They are the the concept and features of the right of silence，the theoretical basis of the right of silence and the arguments and the reasons of the right of silence． Part 2：the historical development and comparation of the right of silence in main countries of the world．From the perspective of the Anglo-American law system and the civil law system，the article gives a brief discussion about the historical development of the right of silence，by the way，it also points the major differences of right of silence between the two major legal systems and the main countries． Part 3：China’S current si
