摘 摘 要 民法时效分为取得时效和消灭时效。民法时效制度作为一项古老 而重要的民事法律制度，起源于古罗马法时代，近代民法继承了这一 制度，到了现代民法，时效制度得以全面发展完善。无论是大陆法系 国家，还是英美法系国家，尽管国情不同，但世界各国均对此予以规 定或承认。在我国己确立了市场经济体制的背景下，为适应经济的市 场化、全球化，法律的体系化、国际化的要求，笔者从分析时效制度 的价值入手，提出了构建我国取得时效制度的设想以及重构我国诉讼 时效制度的方案。 首先，文章通过对时效制度的法律涵义、时效制度的渊源和立法 模式的简要介绍，着重分析了时效制度的价值基础，即民事权利的行 使对于自由、秩序、公平和效率的影响，从而得出时效制度的价值结 论。认为时效制度具有稳定社会经济秩序、督促权利人及时行使权利、 便于人民法院查明案件事实正确处理纠纷的价值。 其次对建立我国的取得时效制度作了构想。文章着重介绍了大陆 法系国家不同时期的立法代表如法国、德国、日本及英美法系国家成 功的立法范例后，阐明了取得时效本身所具有的四大功能，揭示了我 国建立取得时效制度的必要性。同时运用了比较的方法对取得时效的 适用范围、构成条件、中止、中断及效力等问题，对取得时效制度作 了较为精细的设计。 最后，对我国的诉讼时效制度作了重构。针对目前学界对诉讼时 效性质的不同理解，文章就我国诉讼时效的性质作了重新界定，认为 诉讼时效的性质为消灭时效，诉讼时效的效力为请求权的消灭。同时 认为对其重构应弘扬民法权利法的精神，以充分保障权利人行使权利 为己任。为此，针对我国《民法通则》关于诉讼时效制度规定在在的 缺陷，在借鉴国外成功的立法经验的基础上，提出了重构我国诉讼时 效制度的具体方案。 关键词： 民法 时效制度 构建 AbstractPrescription Abstract Prescription system of cNil law iS divided into acquisitive prescription and extinctive prescription．Prescription system of civil law,as an old and important civil legal system，ori垂nates from the ancient Roman law times， and modem civil law inherits this system，until contemporary civil law, prescription system has been wholly developed and perfected．No matter in the countries of the continental law system，and in countries of Anglo-American law system,although the national conditions are different， most counties in the world have accepted or regulated the system．Under the background that our country has confirmed the market economy structure，in order to adapt to the requirements of markefilization and globalization of economy,systematization and internationalization of laws，the author starts with the analysis of the value of prescription system,puts forward the tentative idea to construct acquisitive prescription system of our country and the plan to reconstruct the limitation system ofour country． Firstly,the dissertation briefly introduces legal connotation and origin of prescription system and its legislative model，emphasizes to analyze the foundation ofvalue ofprescription system，which is the influ
