摘 摘 要 法院的审判程序和审判机制直接关系到审判价值——公正和 效率的实现。反思我国传统的审判程序和审判机制，不难看出审判 程序和机制上的弊端，如审判管理机制行政化，审判程序和制度的 缺陷，审判人员司法观念陈旧等。要保证审判的公正和效率，必须 建构新的审判程序和审判机制，实现审判流程的科学化管理。 实现“依法治国”方略，建立和完善社会主义市场经济体系以 及加入WTO后世界经济一体化的形势，都期待审判能真正体现公正、 效率。为适应新形势的需要，我国法院系统针对传统的审判程序和 机制中的弊端，进行了一系列的改革，审判流程管理就是审判程序 和审判机制革新的成果之一，它是由法院内部专门机构根据案件在 审理过程中的各个不同的环节和阶段进行组织、管理，并进行跟踪 监督的综合管理诉讼程序和审判管理机制。它是根据审判特点，在 分权制衡、提高效率、维持秩序、尊重规律的理论基础上建立的正 当程序和科学的管理机制。 审判流程管理作为审判程序的价值是要保障审判公正与效率。 同时体现了程序正义和程序效率的内在价值，具有正当性和科学性。 关键词：审判程序价值审判流程管理公正效率 AbstractThe Abstract The trial procedure and mechanism concern directly the trial values．fairness，justice and efficiency．Their defects can be easily found provided that we trace them back to traditional ones，such as the administrative tendency of trial management，the defective trial process and system and the{udge’S obsolescent notions etc．To ensure faimess， justice and efficiency,reconstruct the new trial procedure，and reform the trial mechanism，it is emergent to manage the trial process scientifically． To realize the strategy of rule of law,build the socialist economic system and adopt globalization of the international economy after the entry to WTO．Emphasize the expectation that the trial call actually embody the falmess，justice and efficiency．The new trial procedure and mechanism should be reframed provided that the COUPS refoITll the traditional one which violates the principle ofjustice The management of trial process，which is achieved by the innovation of trial procedure and mechanism．Can be defined as the mechanism of trial management and comprehensive litigation procedure that is organized and supervised by the special agency of the COUPS according to different phases of certain cases．It is also a fair procedure as well as a scientific management mechanism which is framed under the theories of separation of powers， checks and balances，and the notions of improvement of efficiency and maintenance of social order． The value of trial process management．which embodies the inner value
