论监狱警察权益的保护摘 论监狱警察权益的保护 摘 要 监狱人民警察是监狱的管理人员，是刑罚的执行者，担负着惩罚和改造罪 犯，预防和减少犯罪，维护社会秩序，保护国家和人民的利益，保障改革开放 和社会主义现代化建设事业顺利进行的职能，是国家机器的重要组成部分。然 而当前，随着依法治监工作的深入推进，监狱对罪犯权益保障的日益重视与强 化，罪犯的人身安全、身心健康、生活待遇等受到了广泛关注，人大、政协、 检察机关，以及其他社会团体经常深入高墙检查监督。逢罪犯死亡，则重视有 加。与此形成鲜明对比的是，还没有几家对监狱民警的权利保护问题开展系统 的调查与研究。当前由于种种因素的制约，监狱警察的权利保障还不到位，权 利与义务不对等，过多地强调罪犯的权利、监狱警察的义务，而对监狱警察的 权利保障关注不足，这些都是影响监狱警察权利保障的因素。本文主要探讨了 监狱人民警察公权力与私权利保护的问题，存在这些问题的原因分析，以及进 一步完善的对策和建议。 关键词：监狱警察，权利，刑法，监狱法，社会环境 GUARANTEE GUARANTEE OF THE RIGHTS oF THE PIUSON PoLICE ABSTRACT Prison police is the managerial personnel in the prison，as well as the executor of punishment，who shoulder the functions of punishing and reforming prisoners，preventing and reducing crimes，maintaining public order and protect the country and the people’S interests，safeguard the progress of the reform and opening—up and socialist modernization goes smoothly,which is an important component of state apparatus．However,with the development of the administering prisons according to law,the legitimate rights of criminal such as personal safety, physically and mentally healthy and treatment in their daily lives is increasingly and widely attracting the attention in the prison，which is also inspected and supervised by National People’S Congress，the Chinese People’S Political Consultative Conference，procuratorial organs and other social organizations． Highly attention is paid on any the death of criminal，in strong contrast to the guarantee on the rights of the prison police has not been systematically investigated and studied． For a variety of factors limited，guarantee of the rights of the prison police is not perfect，fight and compulsory on an unequal footing，the rights of criminal are overemphasized but less attention on the prison police，all these are affected by the Il police police to protect their own rights． This paper mainly discuss the guaranteeing problem between power and right of prison police，analysis on reasons of the existing problems and further discussion
