内容摘要当前，新型毒品犯罪的定罪量刑、毒品犯罪适用死刑的数量标准以及毒品含 内容摘要 当前，新型毒品犯罪的定罪量刑、毒品犯罪适用死刑的数量标准以及毒品含 量鉴定等问题，已成为困扰审判实践亟需解决的实际问题。笔者通过理论联系实 际、例证分析以及比较研究的方法，对毒品种类、毒品数量、毒品含量与罪刑的 关系进行研究。 论文分三章。第一章是毒品种类与罪刑关系。从法律的角度对毒品概念和特 征进行探讨，并从我国的实际情况出发，对毒品的种类进行划分。在此基础上， 论述毒品种类与定罪量刑的关系。第二章是毒品数量与罪刑关系。在正确理解刑 法有关规定的基础上，对毒品的“起刑点”问题以及适用死刑数量标准问题进行 探讨。同时，就不同种类毒品之间数量换算及其在司法实践中的具体运用提出意 见。第三章是毒品含量与罪刑关系。重点论述毒品含量与适用刑罚的关系，阐述 毒品含量在量刑中的作用和原因，并对我国目前毒品含量与量刑问题进行深入思 考，提出修正的意见和建议。 关键词：毒品 毒品种类 罪刑 AbstractNowadays，the Abstract Nowadays，the issue such as conviction and sentencing concerning new type of narcotic drugs crime，the quantity standard concerning the application of death penalty as well as contents，appraisal of narcotic drugs，has been the practical problem， which has perplexed trail practice urgently to be settled．The author has made research on the kinds of narcotic drugs，its quantity,and relation between content and crime a punishment，on the basis of such methods as intergrating theory with practice， illustration analysis and comparative study． This thesis consists of three chapters．Chapter one：relation between kinds of narcotic drugs and crime a punishment．The author in this chapter discusses the definition and characteristics of narcotics drugs from the view of law．Further，the author has made classification of narcotic drugs from China’S actual situation．On the basis of the aformentioned discussion，the author reinterated the relation between kinds of narcotic drugs and conviction a sentencing．Chapter Two：Relation between quantity of narcotic drugs and crime a punishment．The author expounded the issue of sentencing threshold”and quantify standard in application of death penalty on the basis of correctly understanding related regulations of criminal law．At the same time， the author put forward his own opinions concerning the quantity conversion among different kinds ofnarcotic drugs，and its specific application injudicial practice． Chapter three：Relation between content of narcotic drugs and crime and punishment．The auth
