论我国的反垄断法豁免制度 中文摘要 论我国的反垄断法豁免制度 中文摘要 反垄断法豁免制度作为反垄断法的一项基本制度，在处理规模与效率、垄断与竞 争的关系中凸现着不可替代的积极作用。我国反垄断法对垄断协议和经营者集中、知 识产权、农业等方面的豁免作了原则规定，对特定行业，如自然垄断行业、银行业和 保险业等未作规定；另外，对反垄断豁免的执行机关和执行程序的规定过分简略。完 善中国的反垄断法豁免制度已经显得越来越迫切。本文通过对反垄断法豁免制度的概 念、特征、价值取向等基本理论的分析，在比较典型国家和组织的反垄断法豁免制度 的基础上，对我国反垄断法豁免制度进行研究，将散见于各个章节的反垄断法豁免规 定进行了归纳和总结，结合我国的现实环境，认为完善我国的反垄断法豁免制度，须 对实体规定应当在相关的行业法中作出配套规定，对反垄断豁免程序，应采用司法化 的行政控制模式，反垄断豁免执行机关设置应采用过渡模式，多头负责，待条件成熟 再向统一执法模式转变，反垄断豁免授予应采用事后控制为主，预先审查为辅的模式， 程序应包括立案、审理、决定三个步骤。 关键词：反垄断法 ，豁免制度 ，程序设置 作 者：韦 安 指导老师：曹 博 I On the Exemption System of Anti-monopoly Law of China Abstract As a basic system of anti-monopoly law, the exemption system makes a positive effect which can not be replaced in dealing with the relationship between scale and efficiency, monopoly and competition. The anti-monopoly law of China has regulated the exemption of principle of monopoly agreements with operators focused, intellectual property, agriculture and other aspects, as specific industries, like natural monopoly industry, banking and insurance industry, are not regulated. In addition, the regulations of executive authority and executive program organ of the exemption system of anti-monopoly law is too brief. Improving the exemption system of anti-monopoly law of China has become more and more urgent. In this paper, through the analysis of the basic theory like the concept, characteristics and value orientation of the exemption system of anti-monopoly law, on the basis of comparing the exemption system anti-monopoly law of typical countries and organizations, studying Chinas exemption system of anti-monopoly law, makes summary in every chapter. According to China’s realistic environment, to improve the exemption system of anti-monopoly law, I think it should make matching regulations in industry law.
