II II 济法奖励制度的主体、完善经济法奖励制度奖励的形式、完善经济法奖励制度的 监督机制和评审机制、完善经济法奖励制度的救济制度等五个方面来研究。并且 还提出了一个大胆的设想——在创制经济法典的过程中构建经济奖励法。 经济法作为一部现代法，随着经济社会的不断发展和进步，经济法奖励制度 的作用日益突出和明显，对经济法的奖励制度进行研究和完善，有着重要的意义， 希望本文的研究能够起到抛砖引玉的作用。 关键词：奖励；惩罚；奖励制度；经济法奖励 III III Abstract Punishment and reward are paradoxes, the corresponding purpose of punishment and reward is to punish evil and promote virtuous, which is also the purpose of the legal settings. However, since the invention of the law as the tool, the balance has always been just tending to punishment while ignoring the importance of reward. In the traditional Civil and Commercial law, Administrative law, Criminal law, there are provisions related to reward, but they are set through legal responsibility to regulate violations. The emergence of the Economic law gained close attention to economic incentive. As a modern law which promotes the economic and social development, Economic law is different from the traditional legal department. But there are problems in the incentive system of the present Economic law, which makes it difficult for incentive system to play its due role; we have to research on the improvement of incentive system of the Economic law. The first chapter draw a distinction between rewards and incentives, clear the different definitions of rewards and punishments from economics, social psychology, education，law and other disciplines at first. The research approach of reward and punishment is different，the respect is different，too. But from the comparison of those definition we can find that incentive is the core of the two words. Both reward and punishment prompt people adjusting their behavior and point vigor upon the goals, in other words，incentive should consist of reward and punishment. The research emphasis of this paper is the problems of the reward system of economic law, which is also the reason why this paper choose the perfect of the reward system of economic law.
