I I 摘 要 摘 要 在中国几千年的法律文化长河中，调解作为一种纠纷解决方式占据着显著的地位， 在国际上更有着“东方经验”的美誉，对纠纷的解决具有深远影响并逐渐被其他国家所 接受。就我国目前的状况看，调解的表现形式呈现出多种形态，尽管形式不一、功用各 异但应用范围以及应用频率最高的当属诉讼调解、人民调解以及行政调解等，在现实生 活中我们经常接触的居民调解委员会或者村民调解委员会就是人民调解的范畴，此外各 个行业以及企业内部的调解组织又在很大程度上丰富了调解的内涵。不难发现调解已经 多维度全方位的渗入到了社会生活的各个角落。可以说，在中国这样一个熟人社会中， 调解有着其他纠纷解决方式不可比拟的深厚土壤，它可以将当事人置于轻松的环境下， 缓和双方的对立情绪，互谅互让各退一步友好的解决矛盾，矛盾化解的同时又不至于破 坏两者继续合作的可能。但曾经辉煌一时的调解制度在当下我国社会转型期却被推向了 十字路口，各种调解制度独立运作，调解的弊端日益凸显，各项功能也每况愈下，已经 处在了弱化、萎缩甚至瘫痪的边缘。面对出现的种种问题，是放弃还是拯救？本文通过 列举诉讼调解在实践中遇到的各种问题，深刻剖析了产生这些问题的根源，并针对各种 问题提出了相应的解决办法，力求在理论上为完善该制度尽绵薄之力。 关键词 民事诉讼 诉讼调解 问题 原因 完善途径 II II Abstract Abstract For thousands years of legal culture long river in China，Mediation as a way to settle disputes occupy significant position , in the international has the reputation of Oriental experience, it has a far-reaching influence to settle the dispute and accepted by other countries.
