华 华 中 科 技 大 学 硕 士 学 位 论 文 II II Abstract From the late 20th century to the present, with the vigorous development of the reform and opening up and the socialist market economy, our country is gradually transforming to socialist country under the rule of law, and the legislation is also gradually from the traditional legislature leading to the transformation of the public participation. In recent years, many legislatures of the local legislation in our country have carried out a variety of public participation in practice, and have received the widespread attention from all sectors of society, and have also made some achievements. But for the nascent public participation there are also some shortages, such as lack of the relevant specific operation the supporting system of law, and the public participation enthusiasm, and so on. Therefore, there is a strong need for the research of the public participation in local legislation in China. The paper is divided into five parts. The first part is the summary of the public participation in local legislation. In this part the author defines the meaning and analyzes the development of public participation in local legislation in our country. The second part is the theoretical and the legal basis of the public participation in local legislation in our country. This part first expounds the theoretical foundation of public participation in local legislation from the peoples sovereignty, procedural justice, etc, and then finds support for thelegal public participation in local legislation in the legal from the legal provisions such as the constitution and the laws and regulations in our country. The third part is the analysis of the development and the current status of the public participation in local legislation.
