广西大 广西大学硕士（同等学历申请硕士）学位论文 论姓名权商品化的民法保护 II II ON LEGAL PROTECTION of COMMERCIALIZATION of RIGHT of PERSONAL NAME ABSTRACT Market economy flourishes as well as pursues of economic interests , people commercialized the right of personality,such as the commercialization right of name .Now it’s usual to make money by commercialization the name of those notables,also it’s usual of act of tort.So this article will focus on the way to protect the commercialization of the right of name , especially the property it brought.The research combined Chinese actual situation with experiences of the United States, Germany,focus on the analysis of the difference and will make recommendations at last. This article consists of four chapters : The first chapter , the necessity of research of commercialization of the right of name will be given. The economic development, the need to protect the legitimate rights of the name of economic interests give two reasons to the research. Also legislative and judicial practice requires the necessity of the research. The second chapter, several important issues about the protection of commercialize of the right of name will be pay attention to. There are four questions will be elaborate .Firstly,the theoretical basis of commercialization of III III the right of the name,will be given,then we will make clear of the concept and the character ,at last the difference between the property interests of the right of the name and other right will be compared. The third chapter , in order to pave the way for improving our legal system of the commercialization of right of name ,the USA and Germany in the experience of the commercialization of right of name protection will be compared. So that readers will have an overall understanding the action of USA and Germany on he commercialization of right of name ,also this will make a foundation for future Investigate. The forth chapter ,the way for improving our legal system of the commercialization of right of name
